My filipina fiance has a 2 year rule applied to her visa, and still have about a year and a half left, however we are getting married on May1 2009. The Philippines embassy grants J1 no objection letters if you are married to a US citizen so our plan is to get married, file for immigration and the J1 waiver at the same time as it should only take about 2 months. My question is, is it possible to file for K3 as well before the J1 is waived off her visa? We currently have a case pending with the waiver board in Missouri, they are just waiting for the No Objection letter from the Embassy of the Philippines. My goal is to get her to the US as soon as possible of course.

Im assuming that your fiancee is still in the US and have a year and a half left before her J1 visa expires? You can get married then apply for NOS (no objection statement) starting from the CFO - Phil Embassy- USCIS for favorable recommendation - last would be DHS for the waiver. Why K-3 visa? you want to marry her here in the Phils? You can mary her in the US. I had a J1 visa applied for NOS and J1 waiver for another reason, it is easy as long as you can present your evidence, which is in your case is for her to marry a USC. Good luck in your journey!

Sorry I should specify that my fiance's J1 is now expired and she is now 6 months twords completing her 2 year rule. So she is now back in the philippines. If she was in the US why would we need a K3 haha
