I am married to a Syrian national and we have been married for 2 years now. We applied for the I-129f and the I-130. His interview was on Jan. 7, 2009. The lawyer that we had told us that he should not bring ANYTHING with him to the interview except for the papers sent by uscis, so thats what he did. Well, he was denied and the consular said it was not a bona fide marriage. I immediatly set out and got another lawyer and she tried to keep it at the embassy in Jordan but that did not work and they sent it back to the uscis. Since then I talked with this new lawyer and she suggested that it would be in our best interest and faster to withdraw the present I-130 and open a new I-130. She said she was going to talk to other lawyers and see if they agreed. This has been over 2 weeks now and she will not return any of my phone calls. So I am looking to get yet another lawyer. I have been told by one that we should think about getting a new k-3 started. I talked to the uscis and they said that our I-130 and I-129f are both there under review and they will contact me with a decision in 120 days. I am suppose to go and visit my husband very soon and I am so confused as to what I should do. Should I re-file? What will happen if they deny him? Why is both files being reviewed? What can I do to get the man I love here with me?

Your first lawyer deserves to be more than fired. You need to get a good lawyer at this point one that specializes in Immigration and returned petitions. You will have to address the first denial in your next filing. Marc Ellis was looking for people with returned K1's the other day. I am not sure if he is including other classes in the filing he is preparing.

Hummm what happened to your I-130? did you pursue this?

You should really get a good lawyer... maybe you can write to your congressman or senator.

I'm sorry about the bad advice your lawyer gave you. Maybe if you refile it next time, read more about it so you won't have to lean heavily on your lawyer and trust everything he says.

The letter from the consulate clearly states what to bring to your interview. Your spouse needs to follow what that letter says next time.

Since you said you are married, I'm assuming you filed the K3 not the K1. So which interview did he attend? The one for the K3 visa? or the CR-1 conditional greencard? If only the K3 was denied, I believe you can still pursue the original CR-1 you filed. You just have to send in everything to NVC and move forward. If the CR-1 was denied then I don't think you have any choice but to start over.

As CnT4ever mentioned if you were denied K3 you can still go ahead and followthrough with the CR1 interview. You need to contact NVC to start that process.

How can your I-130 be under review?? They are completely separate visas. Did you pay and go thru the NVC process for the CR-1?

I fail to see why you just couldn't continue with the current I-130 if it's been less than a year.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I have been told that the uscis has it for review and that was all they would tell me. I am looking for another attorney and in my search they been telling me different things. Keep the original I-130 and follow thru with it and one says wait until I get a notice back from the uscis and another says to withdraw everything and start over and one says just forget about the k-3 and withdraw the I-130 and start a new one. I just am so confused about which is the best option.

I don't know why it is there and am trying to find out. I paid the NVC for the I-130 but not sure what you mean by process.

If married for more than 2 yearss you should get a 10 year GC.

Did you complete the I-130 process at NVC? Pay them the $400 and $70 and send in the DS 3032, DS 230, I-864, I-485 and all the original documents?

No I-485 is used in the CR1 or IR1 process.

I just paid the $400 and and $70 when my husband got his interview and then denied so nothing more has been filed and none of the lawyers I have spoke with has asked past the paying .
