Is it illigal to drive a car in USA when your overstaying on a visit, but married and waiting for AOS? Is the police will send me back if they arrest me for a stop light?

Not as far as I can tell. No more/less illegal than if you weren't on overstay..

I wd look for some more imputs ghhere from some more experienced people. Yes what if people on pending AOS is stopped by a cop while driving a car. And what if the immigrant is sitting next to the driver ?

Visa expired : June 12, 2008
Filed for AOS . Sent through USPS Priority Express : March 03, 2009
Package Delieverd at USCIS: March 05, 2009
March 13, 2009 : Checks Cashed
March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card

3/25/11 - Received reminder from USCIS to file for ROC
5/6/11 - Sent I-751 Packet to CSC via usps
5/9/11- Package delivered to csc.
5/11/11- Check cashed electronically by CSC
5/16/11- NOA 1 received

9/6/11 - Approved.Card Production Ordered

It would be great if you updated ur timeline so that we would have better understanding of what is happening. Is your status AOS pending? Do you have a valid driver's license that is allowed by the state that you are in? Best thing to do is to try not to have any arrests on your record.

I am in NY an I am driving on my foreign driver's license along with my international driving permit. I dont think that the police has the authority to send you back to your country, that is an immigration decision. Running a stop light will not justify anyone sending you home.

If you are on AOS pending status and u have a valid driver licence, they would probably give u a ticket and / or arrest u (depends from the infraction u make) but they won't deport u (unless u are out of status and they found out). Police stopped me once 2 month ago cuz one of the light of my car was broken and they didn't even check my immigration status. I gave him my italian drive licence, my international drive licence, insurance and car registraion and that was fine.

When my wife was adjusting from VWP. I didnt let her drive until she had her EAD and we were able to get her a Florida Drivers License. Maybe we were too cautious, but I figured better safe than sorry.
