My wife (US citizen) and I (German) are planning on moving to the States in 2011. As we met and got married and have lived in Germany for the past 6 years she will not be able to document any income in the States for that period. She has no American bank account or assets in the States either. Can her parents act as sponsors for my K3? Can she move her 20k savings(in Euros) to a US bank as proof of funds? She will be employed from February 2011, does this make a difference? Thanks everyone!

The 20K euros won't be enough (barring nightmarish exchange rates in 2011) to satisfy the asset needs for sponsorship. It's a 3:1 (asset:required funds) conversion ratio. The parents can be the joint sponsor.

Wouldn't DCF make more sense for your situation as you both live outside the US?

Direct Consular Filing. It's applicable when both the US citizen and alien spouse live outside the US.

Yeah, I wouldn't bother with the K3 at all. Go for direct consular filing and you'll have a green card instead of a non-immigrant visa. You'll be work authorized as soon as you enter the US and you don't have to AOS after you get here.

Cheaper process as well.
