hi there folks,

I'm in the process of AOS i read the guidelines but still i have some stupid questions... We (me and my hubby) are planning to file this with a "fee waiver" thing, (and we researched about how to be qualified for this and i hope we got approve) now, my question is, is this aos comes in a package i mean, when u file for that will it cover th I-1765 and the I-131 or is this another case? what about in our case where we need to go through this "fee waiver" thing? and if these two aren't covered how much do we have to pay? i checked on the guides here but the link don't work so pls..

Pls advise... thanks a lot friends!

I think, EAD and AP comes for FREE with AOS application...Pls read again the USCIS instructions of the forms. Even if u will NOT file for EAD or AP, you will still pay $1010...

You will have to pay a fee of $1010 for AOS, this also covers Advanced Parole (I-131) (Optional for travel before AOS is sorted) and the EAD (I-765) (Optional, required for employment). With the fee waiver your fiance has to prove that you are unable to pay the fee. Read carefully before you request the waiver. You are a K1 and he needs to prove that he can support you.

thanks for the replies,,, this is our situation, before i get here in u.s. my fiance then (now hubby) got laid off from work december. i got here in u.s. jan 28, after a week, i gave birth to a premature baby, the baby has to transfer to other state cos of his fatal condition through a helicopter ride (he's very much ok now, thank God!) the helicopter ride itself cost $21K not to mention almost $100K doctor and aparratus fee, plus many others plus my bills to the hospital were i delivered him, so all in all we need to pay more or less $200k, we got a medicate for the baby but it don't cover all the cost so we have to pay most of it through sliding scale payment. My hubby applied for an unemployment last feb. they approved him but my hubby wasn't able report with them cos we were at the hospital in nebraska with my son, we stayed there for a month and its far far away home. when my son got out of the hospital, right away we got ssn for me and then get married (march), then by the end of march my hubby got a temporary job and he's working there for three weeks now, and his income now is lower than his previous job. april 28 is the expiration of my visa but we want to file aos right before i get out of status. his income is not sufficient for a household of three and we are going to have a co-sponsor. but we don't have $1010k cash or check or whatever for the aos so we think that we could file for a fee waiver-- if not, then we will be screwed for awhile then file again the next time we got money for that... but i'm thinking, it's best for me to file aos through this fee waiver thing program rather than become out of status individual here, i think that's what the program is for really. i read on the guides here on vj, but nothing really talks about this fee waiver thing, so it's kinda vague for me if if i file under this program, will it cover the EAD and AP as well, if not, how much does te EAD would cost? (we will pay for it just incase our case will get approved under fee waiver, if it's not included on that program) I want to work to help my hubby to straigthen things up again as far as finances.

Pls need advise...

Unfortunately I don't know anything about this situation, but I just wanted to say you're a very strong person for going through all of this! Best of luck to you, and I hope someone comes along who can answer your questions. :)

Sorry about my post before, I did not know about your situation. I hope you get the fee waiver because you certainly deserve too! :yes: I'm glad to hear that your baby is now ok, it must have been such a difficult time for you both and I'm happy you have come through this testing time. I just wish we were in a position to help, because you deserve some help.

I have found this on the USCIS website, it does make a statements regarding fee waivers on the grounds of extraodinary expenses and compassionate reasons. I think you would basically have to provide evidence showing these to be true and then they make the decision. It provides you with details on how you go about applying for the waiver at the end of the document. I hope this will help. It seem as if you are eligible for a fee waiver based on what you explained. I have copied and pasted some information for you but for more you can go to this website. This page can be found at http://www.uscis.gov/feewaiver.

Documentation, such as the suggested examples listed below, may be submitted to provide proof of the "inability to pay":

* Proof of living arrangements (i.e. living with relatives, living in the individual’s own house, apartment, etc.), and evidence of whether the individual’s dependents are residing in his or her household.

* Evidence of current employment or self-employment such as recent pay statements, W-2 forms, statement(s) from the individual’s employer(s) on business stationary showing salary or wages paid, income tax returns (proof of filing of a tax return).

* Mortgage payment receipts, rent receipts, food and clothing receipts, utility bills (such as gas, electricity, telephone, water), child or elder care receipts, tuition bills, transportation expense receipts, medical expense receipts, and proof of other essential expenditures.

* Any other proof of essential expenditures.

* Proof that verifies the individual’s disability. The individual may provide proof of his or her disability by submitting documentation showing that the disability has been previously determined by the Social Security Administration (SSA), the Department of Health and Human Services (HHS), the Department of Veterans Affairs (VA), the Department of Defense (DOD), or other appropriate federal agency.

* Proof of the individual’s extraordinary expenditures or his or her dependents residing in the United States. Essential extraordinary expenses are those which do not occur on a monthly basis but which are necessary for the well being of the individual or his or her dependents.

* Proof that the individual has, within the last 6 months, qualified for and/or received a Federal “means-tested public benefit".

* Documentation to show all assets owned, possessed, or controlled by the individual or by his or her dependents.

* Documentation establishing other financial support or subsidies--such as parental support, alimony, child support, educational scholarships, and fellowships, pensions, Social Security or Veterans Benefits, etc. This includes monetary contributions for the payment of monthly expenses received from adult children, dependents, and other people who are living in the individual’s household, etc

* Documentation of debts and liabilities--what is owed on any outstanding loans, credit cards, etc. by the individual and his or her dependents, and any other expenses the individual is responsible for (i.e. insurance, medical/dental bills, etc.).

How To Apply for a Fee Waiver

* To apply for a fee waiver, an applicant must submit an affidavit—or unsworn declaration that is signed and dated and includes the statement: “I declare under penalty of perjury that the foregoing is true and correct”—requesting a fee waiver and stating the reasons why he/she is unable to pay the filing fee.

* The affidavit and any supporting documentation (see above, Documentation) must be submitted along with the benefit application or petition.

* To facilitate the processing of fee waiver requests, applicants should write in large print “Fee Waiver Request” on the outside of the mailing envelope containing their application or petition and fee waiver request, as well as at the top of their affidavit and each page of their supporting information.

* If a fee waiver request is denied, the entire application package will be returned to the applicant, who must then begin the application process again by re-filing for the benefit with the appropriate fee.
