I just got back from Guatemala and was hoping to find NOA2 but instead got the dreaded Blue RFE...."The divorce decree submitted doesn't show evidence of being civilly filed or recorded". My wife got divorced in England and we submitted her divorce decree but I don't know if there is another form that she was supposed to get. The law office handling her divorce said that this is IT. Trying to get a hold of them now but unfortunately today is a holiday in England, so we'll have to wait until tomorrow to find out what we can do. :-(

Does anybody have experience with Divorce Decrees from England? What is it supposed to look like? The one we submitted was issued by the Cambridge County Court and says "D37 Decree of Absolute (Divorce)" on the bottom. Could it be that the USCIS just doesn't know that THIS IS the divorce decree? Or is there another piece of paper that we're not aware of?

I can't really help you with your issue but just wanted to say hang in there!! I am in the group of CR1 filers right about the same time you filed and we received an RFE dated April 3rd on April 11th. It really does get frustrating when you are expecting an NOA2 and you get an RFE intead. Good luck to you!!

Ok now I am worried, just waiting for my police certificate from England before sending everything to NVC (still waiting for it after 4 weeks but thats another story) my divorce decree is on D37 too just like yours except it says Newcastle County Court and in the bottom left corner says - Certificate making Decree Nisi Absolute (Divorce) but a copy of this was sent to USCIS when I-130 was filed and we were approved without mention of it being wrong.

Timeline

My wife's divorce decree says D37 too, and Gloucestershire County Court it also has the (Certificate making Decree Nisi Absolute (Divorce)) and it has the seal stamp in the bottom right corner. Hers has been good from the Visa to AOS and Removal of Codnitions and Citizenship and now filling for her Parents.

They are looking for some sort of "stamp" or "official seal" on the form probably.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I called USCIS and they don't know what they're looking for either...the lady I spoke with suggested just sending it in again along with an explanation that this is the only form available to show divorce.

TayRivers...are you saying that in addition to the D37 you submitted another form "Certificate making Decree Nisi Absolute (Divorce)"? Because all we have is the D37, no other kind of certificates.

It could also be that the copy I sent in doesn't clearly show the court's stamp since it is in very light ink on the original. Maybe I should send in the original??? Or a better copy?

No I only sent the 1 letter D37 but it does have a stamp/seal on the botom right of the letter, I had to photocopy it in color and increase the darkness on the copy machine to get it to show up.

Just thought I'd give an update...

I submitted another copy of the D37 Divorce Decree. This time a better copy in color that clearly shows the court's stamp. That's the only thing I could think of that could have caused the RFE. The received it on the 16th...hopefully they'll complete the case soon. Does anyone know how that works? Did our petition go to the bottom of the pile or will they resume work on it right away?

BTW...they finally updated our case status online today stating that an RFE was sent...tow weeks after the fact.
