I submitted my petition for a K1 Visa back in January, and I've been waiting for approval since then. Last monday, I was laid off from my work. So, two things:

1. Will I need to update anything with USCIS, now, or when I get a new job?

2. The way I understand it, my fiance won't be able to get the visa until I get a new job (needing the affidavit of support and all), is this true?

1. If nothing else has changed, you should not need to update USCIS about your petition.

2. This depends upon your assets and/or your ability to have a cosponsor and/or whether you get a new job. If you have sufficient assets (see the guides and government forms for details) you can be unemployed and still file the affidavit of support when your fiance has her interview. Alternatively if someone (parent, friend, etc.) can cosponsor you, you may be able to qualify in that manner.

Good luck. It's a rough economy out there, this is happening more and more frequently. :(

You do not have to explain anything to USCIS. They will act on your petition whether or not you have income.

When they approve your petition, in a few weeks your fiancee will begin the process of applying for her visa. At the time of the interview, she will need to provide documents from you that prove you can support her in the U.S. So, you have 2-3 months to look for employment. Otherwise, you will need to find a co-sponsor to submit form I-134 and supporting financial documents to go along with yours. With our high unemployment rate, this is not as unusual as you might think.

The approved petition is valid for only 90 days from date of issue. So, she can't wait very long before applying for the visa and getting in line for the interview. If she waited until you got a job, the approval would expire and you'd need to start all over.

I was in the same situation and we were able to get a K-1 visa usibg a co-sponsor but that was through the Mumabi embassy. What you need to do is call the consulate and ask them if they accept co-sponsors also ask if they consider unemployment as income. If they don't accept the co-sponsor or the unemployment I would suggest finding any job for the mean time that will out you above the poverty level.

2) USCIS does not care about your financial situation

2) You need to understand what CDJ requires when it comes interview time
