hey guys,

Haven't posted on here in awhile, and thus my visa lingo may be out of date, however I am SO confused with this AOS process.

We are trying to get started on the process now, and the beginning is already stumping me.

I found in the guides on this page (http://www.visajourney.com/forums/index.php?autocom=custom&page=i130guide2) that on one page we need to file an I-130, while on this page (http://www.visajourney.com/forums/index.php?autocom=custom&page=k1k3aos) it tells me to use some different forms.

My wife came here on a K1 visa and we are out of the 90 days since she's been here, thus we're filing for AOS late.

Is there anything else we need to do?

Timeline

The forms you need to fill out for AOS are:

I-485 (AOS) and then if you want, I-765 (Work Authorization) and I-131 (Advance Parole travel document). The fee includes all 3 applications, so you may as well get them because you're paying for it. But, the I-765 and I-131 are not mandatory.

You will also need to fill out Form I-864 (Affidavit of Support).

As long as you got married 90 days after your fiance arrived in the U.S. with the K-1 visa, you are fine. You are supposed to file the AOS as soon as possible, but it's not a big deal if it's not within 90 days. The 90 days is the time frame that you MUST marry after arrival in the U.S.

Sept. 9/08... SSA office to change status to "U.S. citizen"

Oct. 8/08... Applied in person for U.S. Passport

Oct. 22/08... U.S. Passport received

Apr. 6/05... DS-230, Part I faxed to Vancouver Consulate

May 26/05... K-2 Interview - APPROVED!!!!

Sept. 5/05... Entered U.S.

Sept. 7/05... I-485 & I-131 sent to CLB

Feb. 22/06... AOS Interview - APPROVED!!!!! (Passport NOT stamped)

Dec. 4/07... I-751 sent to NSC

May 23/08... 10-Yr. PR Card arrives in the mail

Mar. 22/11.... N-400 sent to AZ

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

Oh yea, about the 90 days, we're already married now and were married within the 90 days, but just haven't filed for AOS, but we're doing so now.

OK this process is pretty confusing.

So on the second page I linked to my thread, it says we need the G-325A as well as the I-864 affidavit of support.

Don't we need to turn those in as well in addition to I485, I-765, and I-131?

Oh and ANOTHER question.

On these forms where it asks for you to put your FAMILY NAME, do you put your MAIDEN name or your new name?

Yes, you will also need the G-325A.

And when filling out any forms from now on (now that you are married), you will use whatever last name you intend to use legally for everything. That can either be the maiden name or the married name, it's your choice. But you should use either the maiden name or married name on everything from now on.
