Hello,

I am just trying to do a little planning ahead of time. I was wondering, after my fiancee is aproved for the K-1 visa, she comes to the US and we get married, how long after that is she alowed to leave the country and come back without any troubles. I see that the green card can take up to a year in Vermont.

I will apply for the EAD asap.

04/09/09 : I-129F Sent to Vermont

04/10/09 : I-129F Received by USCIS

04/14/09 : NOA1

08/19/09 : NOA2

08/24/09 : NVC Received

08/25/09 : NVC Left

08/27/09 : Consulate received

08/28/09 : Packet 3

08/31/09 : Packet 3 sent

09/16/09 : Interview - Approved

09/21/09 : Trip to Dallas

Once married - file for AOS (at same time, file for EAD and AP - advance parole). AP will allow re-entry to the US - typically AP takes 30-60 days (for non-emergency AP). :thumbs:

AP = Form I-131 (Application for Travel Document - AP) You apply for it at the same time as you apply for the green-card (I-485). You'll fill out 3 petitions at that time; the I-485 (the AOS), the I-131 (Travel Document) and the I-765 (Employment Authorization).

The I-131 and I-765 are optional, and are covered int he cost of the AOS, but a very good idea to fill out and send off....both the EAD and the AP will take on average two months to be approved, while the green-card can sometimes take longer to be approved. If you have the EAD you can work while you wait for the green-card, and if you have the AP, you can travel while your AOS is pending.

Personally I think 60-90 days is a better estimate for the AP and EAD.

31st January 2008 - NOA2 issued

22nd May 2008 - Interview date

18th July 2008 - US here I come

22nd August 2008 - Wedding date

15th September 2008 - AOS Pack (I485, I131, I765) Sent

22nd September 2008 - NOA1 x 3 Received

6th October 2008 - Transferred to CSC

17th October 2008 - Biometrics

5th December 2008 - EAD & AP approved

20th February 2008 - GC approved

I-751

================

1st December 2010 - I-751 Sent (CSC)

3rd December 2010 - I-751 Received

7th December 2010 - Cheque cashed

3rd January 2011 - Biometrics
