Well, Daisy...

Here is another suggestion... why not get married first and convert your K1 to CR1 (I think it is the spouse application)... It will be a little bit longer on the waiting list, but for sure by doing this you will have a better chance... (correct me if I am wrong, guys)....

Well, Daisy...

How does this improve her chances with the waiver? It will still be needed.

She is inadmissible....no matter what visa class.

The Consulate does not have any options, as it is required by law. A waiver is authorized for the inadmissibility.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

don't get me wrong, a waiver still needed. But a spouse visa is more concrete comparing to a finacee visa as long as the marriage is true and the evidences can prove that, finacee visa only for intended to marry (from the INS point of view).

I think it would have a positive effect in getting a waiver approved...after the visa is denied. So would having 3 kids.

The fact that her fiance has a business in the US, that he cannot leave is the only thing Ive seen so far that makes a waiver approveable.

In order to build a stronger case for Daisy, marriage might be an alternative direction to get her waiver and approval of her visa. Instead of a K1 visa is only for intended to marry purposes which INS will care if Daisy might do the same as before.

getting a visa approved, and getting a waiver approved are two different issues. The Consulate does not approve waivers.

You seem to be mixing the two together...but they are separate processes and go to different agencies.

The relationship issue deals with whether or not it (the relationship) is for the purpose of evading immigration law to gain entry to the USA. If there is doubt as to the validity of the relationship it makes no difference whether the relationship is at the pre- or post-marriage stage. The act of marriage does not overcome the doubt.

Her visa WILL be denied based on her overstay and she is facing a 10 year ban.

According to the law, fiances are eligible to apply for waivers so it makes no difference if they are married or just engaged. When it comes to her fiance's ability to prove extreme hardship to HIM if he had to move to her country if her visa were denied, whether or not they are married doesn't play much of a part.

If we knew Daisy's location, we could tell her about the approval rates and timing there.
