Now after reading so many people's opinion I totally lose hope that I will ever be able to return to the US...I will talk with my fiance about hiring an attorney and see what happens....

I know it is a good question why I left on first place....it is a long story but now I totally regret it.... it was very spontaneous decision....:unsure:

But unfortunately I can't turn back time and now I guess I have to face the consequences ....and I guess this is the denial....oh well ...thanks anyway for all of your replies..... :crying::crying:

I'm sorry :( But it's not the end of world. Like someone suggested maybe you can try migrating to another country, maybe Canada or the UK.

I agree it is not the end of the world but my fiance is in the US not in another country...I know I violated the immigration law by overstaying but there are millions of people already who have overstayed in the US ....But aren't they going to violate the human rights of a US citizen if he can't marry whoever he wants... :(

Your fiance can absolutely marry you. No one is saying he can't.

And believe me, ALL of us on this site see the endless ironies in us going the long route to do things legally while they ponder amnesty for illegals. That's nothing new to us!

How exactly is not allowing you to live in America is 'violating his human rights'??? :blink: *shrug*

There is a subtle difference between an overstayer and a person who entered illegally. Which are you??..how did you enter the US originally??

How did you manage to be a non-person for 3 years in the US?? you didnt work?? do you have a SSN??

etc.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Umm... he IS in another country. He is in the US and you are wherever you are.

I was following along and feeling somehwat sympathetic until you pulled the 'human rights' card. Trust me, you do NOT want to continue this train of thought (legal vs illegal process) with the people on this forum.

Certainly you're not implying that your human rights are being violated simply because you're being denied entry to the US....

What I meant to say is that maybe you both can get married and live somewhere else besides the US. The US is wonderful and great, but it's not the only country in the world.

I totally agree... The first thing my fiancé (now my husband) and I agreed to do as soon as we decided to get married, was that in the case my visa process got complicated by any reason (although I'd never been in the US ilegally) he would move to my country or we would decide about another place to live. I'm very sorry you cannot do it your way, but as someone said before, it's not the end of the world. It is tough, that's right, but it's certain... the good thing about what is "certain" is that you are forced to move on and look for other solutions. I'm sure he would move anywhere in order to be with you the same way you are willing to do it for him.

Unless your only interest is to get back to the US... I hope not....:no:

To the question of desert fox:I entered the country legally with business visa and I overstayed...Yes i did work there altough I knew I was not supposed to...I didn't have SS number but I had a bank account on my name....My fiance can't move to another country because his business is in the US ....But I don't know ..We haven't talked about this....he always asssures me of that I have to be positive and that the visa issue will be solved.....and that I will return to the US ......but as someone already said we will need a lawyer and God knows how long it would take us.....one so spontaneous decision ( me leaving) ....resulted in nothing but one nightmare .... :crying::crying::crying::crying::crying::crying::crying:

Just a point of clarification: it wasn't your decision to leave that caused this problem. It was the lateness of your decision to stay (aka an overstay) that got you in this mess.

Yes there is a chance that you won't be able to return to the US but there is also a chance that you would get an approved waiver - others have. I know it's upsetting but you chose to break the law and these are the consequences. You may have to stick it out for the long haul of trying to get an approved visa like many others on this site have done. If you really want to be with someone it's worth it!

And you havent 'lost all hope' - you havent TRIED yet to apply and see if you need a waiver, filed waiver and find out if its accepted..there are many more things to go thru and look into before 'all hope of re-entering the US is lost'

If you are going to give up at the first hurdle then you will never survive the NORMAL immigration visa process, never mind one with 'special circumstances'

Dec 27th - NOA1 received by snail mail!

Dec 29th - 'Touched'

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

[ Ok let's assume that they will deny it...then if we file a waiver how long do you usually wait for a waiver to be approved????

Your fiancee needs to start the I-129F petition. Depends on what country you are in to determine how long until the interview....figure 7 months. Once denied, another 4-6 months or so of waiting for the waiver decision after it is submitted.

All you seem to care about is getting the US as FAST AS YOU POSSIBLY can....If you love your fiance...which you should since you want to marry him...then you will wait like the rest of us did...there are HEAPS of people on here who have been denied and have had to wait through waivers, through Administrative Processing, through denials and appeals and months after months...sometimes YEARS of waiting...but people on this site do it because they are in love and will do anything to be with their SO.

So far as I've seen no one decided the wait was too long and called off the process. If your only interest is to get to America...rethink the family migration route....if you truly love your fiance...then you'll wait just like the rest of us.

Finally finished with immigration in 2012!
