I-765 Work Visa - When do i send it?

We are in the process of filing for our K1 Visa and i wonder if i want to be able to work once were married when do i submit the I-765 form? Does anyone know? Is it with the I-129F pack or later than that?

05/10/2010 - Sent AOS Package to USCIS

06/10/2010 - AOS Package received at Chicago Lockbox

14/10/2010 - Email/Text sent from USCIS to say they had received our AOS and NOA1 was in the mail

18/10/2010 - NOA1 Received via Mail

22/10/2010 - Received Biometrics Appointment Letter

08/11/2010 - Biometrics Appointment

18/12/2010 - Letter received for interview appointment

21/12/2010 - Received EAD and AP

21/01/2011 - Interview!

AOS APPROVED!

03/25/2011 - Green Card Received

Hi,

Because you are K1, you will file your AOS(adjustment of status) along with your EAD or I-765(employment authorization) after you got married.EAD is not included in I-129F...

K-3 VISA:

EAD:

04.20.2009 : Received Date

05.05.2009 : Received NOA from USCIS

07.28.2009 : Biometrics Appointment

08.04.2009 : EAD Card REceived in mail

AOS:

02.22.2010 : Mailed AOS Application via USPS Express Mail

02.23.2010 : Received date (Chicago Lockbox)

03.02.2010 : Received NOA

03.25.2010 : Biometrics Appointment

05.14.2010 : Interview [Passed!!! Yahoo! Thank God :)]

06.12.2010 : Green Card Received

You have two options with the K-1 visa.

1) prepare it now (or whenever) and place it in a US mail box immediately (or shortly thereafter) after your arrival on your K-1 visa with a check for $340 and wait 2-3 months.

2) Wait until after you are married and submit it with your AOS for FREE and wait 2-3 months. If you will get married and file AOS fairly quickly after arriving, I would wait and file it with AOS. If you are anxious to work and will wait for nearly 90 days to file AOS, maybe it is a good idea for you to do it earlier.

You cannot do it before arriving in the USA under the K-1 visa

You cannot do it before arriving in the USA under the K-1 visa

Option 1 is only valid until your I-94 expires which is 90 days after entry. If it takes 2 -3 months to receive it is a waste of money since you do not have work authorization after the 90 days.

Wow, that sucks! Do you know if i cant work am i allowed to volunteer or is that classed as work? Can i study also if i want to? Im more than happy to file it asap but my fiance is in North Carolina and there is really not a lot around Goldsboro so would like to meet some people somehow!

You can definitely volunteer. It helped keep me sane.

Check out the AOS guides. The sooner you send your AOS off, the sooner you get your EAD, so it can be a good idea to start getting things together while you have a chance.

K-1 Application

2nd October 2007 - I-129F sent to CSC

10th October 2007 - NOA1 issued

31st January 2008 - NOA2 issued

22nd May 2008 - Interview date

18th July 2008 - US here I come

22nd August 2008 - Wedding date

AOS

================

15th September 2008 - AOS Pack (I485, I131, I765) Sent

22nd September 2008 - NOA1 x 3 Received

6th October 2008 - Transferred to CSC

17th October 2008 - Biometrics

5th December 2008 - EAD & AP approved

20th February 2008 - GC approved

I-751

================

1st December 2010 - I-751 Sent (CSC)

3rd December 2010 - I-751 Received

7th December 2010 - Cheque cashed

3rd January 2011 - Biometrics

Volunteer, yes, absolutely.

Study? Depends on the school, in most, yes. You ARE here legally, you are just not a resident yet. States and individual schools will make their own rules about this. My wife began her education immediately, within four days of arriving.
