Please correct me if I am wrong about any of this

1- Have time for 2 years to the AOS after she enters the US

2- If I do not file for AOS(green card), I can ask for extension, extension is usually 2 years

3- To leave and return to the US the lady does not Advnaced Parole

4- There will be an interview for AOS

5- Unlike CR1 visa, after my wife enters the US she cannot get a job or driver license since we have not done the AOS and she does not have a SSN. K-3 is NOT work authorized

Anything else??

Three questions:

1-After you file for AOS, how long does it take to get the social security card in the mail? Time range?

2-For K3 I must do K-129F, do I also need to do I-130?

3-Can she apply for EAD so she work is she wants without applying for AOS?

K-129F???

Answer:

1.) I dont know the answer

2.) In order to obtain a K3 visa,you must file 1st the I-130 on USCIS and then I-129F next

3.) She can apply EAD now(pay $340) and then AOS later but still need to pay $1010. That is my plan also, i didnt file my AOS(adjustment of status) yet

08.04.2009 : EAD Card REceived in mail

AOS:

02.22.2010 : Mailed AOS Application via USPS Express Mail

02.23.2010 : Received date (Chicago Lockbox)

03.02.2010 : Received NOA

03.25.2010 : Biometrics Appointment

05.14.2010 : Interview [Passed!!! Yahoo! Thank God :)]

06.12.2010 : Green Card Received

Sometimes yes, sometimes no.

5- Unlike CR1 visa, after my wife enters the US she cannot get a job or driver license since we have not done the AOS and she does not have a SSN. K-3 is NOT work authorized

Yes, she will need an EAD for work. Driver's license varies from state to state.

Anything else??

K-3 is a waste of time and money. You SO will probably get here a month or so earlier with K-3, but there's really not much difference now time wise. I consider K-3 obsolete.

For K-3 you file I-130 first, wait for NOA1 and then file I-129F. In reality when you apply for K-3, you are also applying for CR-1 at the same time. The I-130 is for the CR-1

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Why you want to wait for AOS for SSN?

Once beneficiary here in US apply EAD and SSN.
