thank you soooo much... i do have legal sole custody of my kids he has visitations only so maybe i that will help i had no idea i could fight it ....

U have legal sole custody?? Oh yeah you dont need his permisson. Just send a copy of your papers with your form and your good to go.

Yeah, you sure can fight it. I had to go through this with my oldest daughter. I have sole legal custody but I did not have an official copy of the court order. The copy I had did not have the seal so I had to go to the court clerk and pay to get the official copy with the seal. Once I had that in hand and showed it to them they process it right away. They had been holding her passport so I was able to get it from them that same day. The only thing they did question as to whether I had tried to obtain his signature and they wanted to document my response with the application but I had already completed that section where it asked for an explanation if signature cannot be obtained. She read that, made a few red marks but everything was fine.

I WAS JUST GOING BY THE LADY WHERE WE APPLIED FOR THE PASSPORTS SHE WAS LIKE HAS TO BE HERE AD SIGN I WAS CRUSHED AND SHE AND EVERYONE ELSE MADE IT SEEM THERE WAS NO WAY AROUND THANKS EVERYONE FOR THE INFO.

Did you tell the lady you had sole custody?? I'm sure if you would have that would have shut her up and then she could have instructeed you on to proceed..
