ladies, I would be careful about how you'll throw around the word sole custody. Sole custody does not take away a parent right. I don't know any one's situation, but I think some of you are confusing sole custody with physical custody. I am not stating any of this to start a diagreement with anything that has been said on previous post, but as I sit here reading some of these comments, I just felt it was necessary to state this fact. A father, and mother have equal responsibility and rights regarding their child, unless they have SIGNED that right away. So, yes a Parent (father or mother) with the other only having physical custody, can refuse to grant permission for their child to leave their birth country.

Not to really stir this up either but I know someone who is a family attorney who deals with divorces and stuff but sole custody is when one parent makes all decision for their child, what they eat, where they sleep, where they can go while the other parent only has visitation rights and can not make any decisions for the child unless the other parent who has sole custody agrees on it...Even looking up the word in the dictionary it states:

Sole Custody is an arrangement whereby only one parent has physical and legal custody of a child and the other parent has only visitation rights. Also, an order of the court that provides that children reside with one parent and that parent is responsible for all decisions affecting them.

So they do not need any permission from the father for the child's passport if they don't want it...I know when getting my son's passport I was getting into the same problem even though i wasn't married to my son's father but i just wrote a letter stating the father is not around and i don't know where he is and i showed that my son lives with me and that i'm the primary care-giver and they accepted it...

thanks roxcie.. u are correct in that sole and physical custody are 2 different things and people get it mixed up..

in MY case i have sole custody or conservatorship..and can decide on my own, where and when my kids come and go, all health related issues, where we live, and they go to school. he has visitation rights and the right to be advised of what decisions ive made..

it was for this very reason i did not want "joint conservatorship" w/ physical custody.. becuz i WOULD have to go thru him for every lil thing.

ive researched it and the state dept says that u can provide ur documentation of "sole custody or conservatorship" and they do not require the other parent's signature to issue the child's passport.

women and men just have to know just cuz the child lives w/ them they do not have sole custody.. it has to say that in the agreement. u can do ur research in ur state to see what's what..

I'm new to the board although I've been reading your posts for quite some time now so I feel as though I know you guys already. I just filed my K1 earlier this week so I'm sure I'll be seeking support during this process. Oh Father! the anxiety of it all!

4/17/09- VSC cashed check

4/17/09-NOA1 online

4/20/09-NOA1 hard copy

4/20/09-Touched

4/20/09- now we wait...

8/27/09- touched

8/31/09- approved!!

9/4/09- letter saying they mailed info to kingston

11/16/09 sent DS230 via email

11/18/09 rec email stating interview was scheduled for Dec

11/19/09 sent email asking what day in Dec and they responded Dec 8th!!!!! 2WEEKS

11/20/09 rescheduled to Dec 22 my preference date

12/22/09 Went to JA 12/9 and di ting is postponed until mi kno it's right!!! mi nah rush into nothing mi rather wait forever and kno everyting proper and sort out then rush and bawl lata... Mi kno when mi ting ah happen it ah happen RIGHT suh fah now mi ah wait likkle more...

10/14/08 Case complete!! Waiting for the interview date.... HURRY PLEASE!!!

01/06/09 Interview date: February 17 @ 7:30AM!!!!!!!

02/03/09 Hubby's dr's appt. (All went well)

02/17/09 Interview day... APPROVED! He should receive his Visa the first week in March.

02/24/09 My bday!! AND hubby was called to pick up his visa!!!! GREAT BDAY GIFT!!

03/27/09 My hubby surprised me at my job!!! Can not believe he's finally here!

Part of wonders if I enjoy sneaking away because its my umm how do I put it . O.k. put it like this I think I grew up wayyyyy to fast. Having kids, getting married all that. I jumped right out of high school and into the grown and sexy. Well I never got to be that young adult that partied and clubbed and went away to college and do the crazy things people do before they have kids and get married so am I now having a early life crisis where I’m like freak that I want to have fun?? Cause when I go to JA boy do I have fun. IDK just a thought...

Never heard of an EARLY life crisis before, lol. My party & clubbing years were few... I remember going to the college parties blaring Lil Jon music for a couple of years. Fun times. But now, I can't even listen to the same music that I used to. It just seems too loud and vulgar... and I'm not even 27 yet. :lol:

u too honey.. i was soo geeked on meeting u, i was talking bout it all day.. man i wish i could have stayed.. my phone was ringing off the hook, some problems w/ my brother.. ugghhh the burden of being the oldest LOL

i don't blame Derron, it was REALLY crowded.. i couldn't believe it, its normally just a nice crowd there, but wed must be getting popular last couple of weeks.. been BANANAS!! okay so when ya'll up for another weekday late night.. try the ultra lounge on mondays.. ALOT less people, same OFF THE CHAIN music..

LAMO..yes i don't even know when last day is..all i know is that week they have pure halfa day which no mek no sense to me..so u know wah might happen right!

her school as summer camp..i think she'll be going there..
