Confusion regarding SSN & TAX extension

Hi All,

I am in a bit of confusion regarding filing of taxes together. As you can see from my timeline, I had just given my biometrics and waiting for the NOA2 with some decision about EAD. Without the EAD I cannot apply for SSN. And without SSN I cannot file joint with my wife. Now we can file for an extension and wait for my SSN to come. BUt then with the I-864 we have sent 2005,2006,2007 tax returns as we applied on the 1st week of March,09.

I hope they wont ask for more, but if they ask for the 2008 returns, what wd we show ? that we filed for an extension ?

File a IRS W7 WITH you guys returns and get a ITIN.

As far as i know the ITIN is a non working SSN . Right ?

So you are saying to file the return now only and attach a filled up W7 form ??

Or are you saying to file an extension and file a W7 with it .

So after I get my EAD what happens to this ITIN ?? will I have to apply for SSN again ?

Can't meet the deadline? E-file form 4868 to request an extension of time - there are no restrictions so all taxpayers qualify. Another way is to choose a company who can help file your taxes. There are links to tax filing companies on IRS.gov. By going directly to a company's Web site, there is a chance you may not get the free Electronic Filing service. Remember - you are under no obligation to buy anybody services.

Another answer is:

You can file an extension any time between now and April 15, using Form 4868. The important thing to know is that filing for an extension of time to file your tax return does not extend the amount of time you have to pay. The IRS expects you to estimate your tax liability, and if you think you will owe any money, you must pay it with the extension.

If you don’t pay, or you underestimate the amount to pay, you will be charged interest and penalties on that unpaid amount from the time it was due until you actually pay it. So it’s important to be careful and pay enough to cover all your liabilities when you file the extension.

I think you can download the form online and yes they most likely will ask you for your 2008 tax returns. Be totally prepared and never leave anything for granted. It is best you have all areas covered rather than to go unprepared. On the interview letter they specifically ask that you take the most recent tax documents and they do not mean the most recent one you submitted which in your case is 2007 but that means for the year 2008. I hope my answer helped somewhat.

Thanks for the Research Kcoyclay1. Yup but dnt you think before the interview i wd get my SSN and wd be able to file togther and get the returns? I think I have enough time for that before the interview. Though none of us know when they wd set up the interview. I was talking about RFE. I am affirming that as I hav`nt got any RFE till now , i wont get any. So if in a RFE they want 2008 ones what wd i show ? Regarding showing 2008 ones at interview stage I think I will have enough time. Dnt you think so ?

But if I rake a statistics of time from your timeline Kacioclay,

One get almost 2 months time from the biometrics time to Interview date. Now you got your SSN in hand only 25 days prior to your interview. I wonder if 25 days is enough to file togther and get returns in hand . Any idea how long it takes ?

My wife included me as her dependent in her 2008 tax return. She filed it about a month ago. The tax preparer advised me to get ITIN. He filled out the form and i signed it. I dont think ITIN is a "non-working SSN". I think you can only use it for tax purposes.

Sorry for not responding sooner. You are given a copy of your return the very day you file and that is what you will use at the interview, just make a copy of it. As I said before, my accountant told me that the deadline is for those who are requesting an extension and also for those who will owe the IRS. He said you can claim for up to three years in the back. We however can't do that as we need to file as evidence of a bonafide marriage. An ITIN is not a non-working SS# as visacheck said. It is for taxpaying purpose. When you get your EAD you need to apply for you SS#.
