My husbands co-sponsor (father in law) done with his affidavit of support attached there is his emploment cert, bank statement, paystab and w-2s for past 3 years but he doesnt have his ITRs because he's not getting them and its almost five years. "HE IS PAYING TAX BUT THE THINGS IS HE DONT GET HIS ITRs because his reason is he dont need extra money and he is lazy". Also, it seems its impossible to get his and its a lot of work my interview is coming up...

will i get deny becuase i dont have my father in law ITRs even if he is paying tax but he dont claim them? does w-2s for past 3 years will suffice?

please help me im super depressed!

By "ITRs" I am presuming you mean tax returns?

You have two options.

1.Get another co-sponsor, let them know the requirements up front and don't waste time with people that can't help you. You can postpone your interview if needed until the co-sponsor is secured.

2. His father can prepare and file income tax returns for thos three years NOW. Go on the web and search "1040/2006" for example. The forms are available. He will not be penalized for filing now IF they owe him money (as you suggest but he is so rich he doesn't need it, in which case, forward the check to me) Wealthy people do not get wealthy by giving the government more than they are due.

Unless consulate specific you only need one years tax return from each person. 2008 will do nicely.
