K3 Visa? Or IR1/CR1 visa ?

I have sent the I 130 and have received an receipt number. Now I am getting ready to file either the K 3 or the IR1/CR1 visa . But I dont know which one. First off. in the I29f instructions it says " you must submit the documents required in items 1,2 and 4 of the instructions but can ommit the documents required in items 3" What does that mean? What documents do I need and dont need? And for the IR1/CR1 visa, what is the difference between the K3 and CR1? and where do I find those forms. Thanks

First of all, the form for the CR1 is the I-130 that you already sent, if you only wanna do the CR1 you can only now wait for your approval.

But if you also want to apply for the K3 you will need to file the I-129F form.

CR1 Process on NVC:

03/03/09 - NVC received papers

03/05/09 - NVC number assigned

03/09/09 - NVC generated DS 3032 and AOS bill

03/10/09 - E-mailed and mailed DS 3032

03/13/09 - Paid for AOS bill

03/18/09 - Choice of agent accepted by e-mail

03/20/09 - Got e-mail with IV bill

03/20/09 - Paid for IV bill

03/25/09 - Sent the IV DS-230 packet by mail direct from beneficiary's country

03/28/09 - Sent the AOS packet by mail

04/01/09 - AOS packet delivered at NVC

04/08/09 - DS-230 Packet delivered at NVC ( I don't know why that long it was stuck at Customs for like 2 weeks!!!)

04/09/09 - AVR says it's missing the DS-230 (False RFE)

04/09/09 - AOS approved

04/10/09 - DS 230 entered into the system, probably under review now.

04/13/09 - AVR says "The NVC has received the checklist letter response on April 10th"

04/20/09 - Case Completed at NVC

04/24/09 - Got e-mail with the appointment letter

Consular Process

05/26/09 - Medical Exam

06/03/09 - Interview Date!!!! PASSED!!

06/06/09 - Received passport and the Big Brown Envelope

06/24/09 - POE

IMO, if I was to do it again, I would've stuck with the CR1 process...you file your I-130, then they have up to 180 days to approve the application...if you file the K3, the 180 days starts all over again...even tho I got stuck in the summer of '07 mess, I still would've gone the CR1 process...take a look at some timelines to see how the processes are going now. It also depends which Service Center you're dealing with, California or Vermont. Good luck!

Forget filing the I-129F [K3] and go with the I-130 [CR-1/IR-1]. CR- 1 is married for less than 2 years IR is married more than 2 years. CR get s a 2 year visa. IR- 1 gets a 10 year.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I would suggest going the CR1 route too. The difference in time is minimal using the steps described in the CR1/IR1 thread. The Canadian Consulate is the only exception I know of where the wait is significantly longer.

Absolutely, especially for people going to the US Embassy in Lima. If you take LingChe's NVC shortcuts, you may be able to get an interview a few weeks faster than a K3 visa.

Just so you understand the process, CR1/IR1 visas used to take years to process a few years ago and that's why they created the K3 visa, so that the beneficiary could get here faster. That's no longer the case because CR1 visas do not take as long as they used to, so filing for a K3 in my opinion is a waste of not only money but valuable time.

A CR-1 takes aporxamately 5 months in my case but some people are having their petitions approved much faster than ours was. I would go the CR1 route again as when the beneficiery arives there is more freedom and it costs less to file in the long run
