I have a question about I-864, I did not claim my veteran compensation benefits on my income tax (the benefits are not taxable), my income last year was less than the required income for the I-864 process (excluding my veteran compensation benefits) however I just got hired last month with an annually base salary of over $50000 after graduating college. Do I have to wait six months to show on my paystub that I will meet the required income? Can I use my VA benefits even if I did not claim them on my taxes? Will a letter form my employer about my current earns be anofe, even if my income last year did not meet the requirements. I don’t have the choice of using a co signer pretty all my friends are under paid soldiers or students.

Do I need to send the I-864 before NVC sends the interview package?

The veteran compensation should be eligible as income. I assume that it is an ongoing benefit. In reading the I-864 instructions for question 23 it says: If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income. It sounds like it would qualify as "other."

They are more concerned with current income. Your new position certainly puts you well above the bar. Do the benefits themself exceed 22,887? Regarding the months of pay stubs, I'd contact the embassy to learn what they will accept.

Send the I-864 as instructed by the embassy.

I see from your timeline that you are going through Lagos. That can be a tough embassy. Get as much guidance as you can from other VJ'ers going through there as well.

Thank you for your comments it was helpful. Yes the benefits exceed 22887 in total, but they do not exceed 22887 annually, however with my taxable income from the previous years and the benefits would be more than anfoe to qualify for five people, and I only need it qualify for three.

I really don’t know if they will accept the benefits, because I did not put them on my income tax, I called the VA and the represented and he sent me my payment history and benefit entitlement letter, he told me that the benefits are not taxable, and it can’t be applied to my taxed income.
