anyone appeal before? should i refile i-130???

sorry been working all week, I tried to reply on the last post but i kept getting errors so i start this new one.

we got basically we didnt prepare for the interview. Here r the reasons they failed us.

*photographs as evidence indicate we only spent 4 or 5 days together. they r wrong about this. we spent 3 weeks together, we dont take pictuer every times we go out.

*Petitioner has not returned to visit beneficiary since Oct 07. I couldn't because in 07 VSC was having problem with the paper load. it took us 3 months just to recevie our case number. took us a year and half for her interview. i wanted to stay and finish the paper work over here. I went back last month after we found out they spent our case back.

*Beneficiary is unaware of basic facts of Petitioner's family. On her interview they asked her the name of all my bro and sis company name. we didn't expect them to ask those questions. I mention to her once or twice but guess we forgot on the interview.

*Beneficiary is unaware of petitioner's personal history. They asked my wife all of my the company i worked before. she answer them all. but the thing is i was working for those company but i got paid by a temp agency. I think the name of the temp agency appear on my tax return instead of all those companies. this was our mistake... which cause of everything

*Beneficiary and Petitoner did not have an engagement ceremony. I didn't know they expect us to have one. my sister and my parent went with me to her family to should her family we r serious about this relationship before i went back to USA. We met in mid May and in Sept I went back with my parent for our wedding.

They spend my wife all her evidence back last week. Our case is on it way back for final decision. They probably will revoke it. Does anyone know what i should do now?? Should i appeal which can take up to two years or should i forget about the appeal and refile i-130. anyone know who appeal and was sucess? thanks

You should act as quickly as possible. Try to find out if the case is still at the embassy or not.Try to call the consul and talk to them. But at least tey gave you wife the denia sheet an you knowthereasns why she got denied for visa...

You should also contact the senator/ congressman/ and ask them to show their nterest in your case.

Once the petition is finally back, they will need some extra time before they review your ase at USCIS -It will not be any time soon, then oce they review your petition they will send you NOIR or DOID and you will be given 30 days to respond with good reasons-probably you need the attorney to show good supportive documents that your marriage is true. You shoulddo your best to overcome the accusation. A good attorney will be HELP !

Also you can visit your wife to her country -so it will be a help somehow (may be)

You should post your case in other section, ppl there are experienced with that .(221 denial section) I am one among them . :)

Refiling the new petition is not a good idea a this stage, because, that can be denied at USCIS, as you didn't respond them previously.

Creating a new thread every week and ask the same question over and over will NOT solve anything. Get over with it. You two did a lousy job preparing for the interview and have failed. Sitting here making up excuses for your mistakes won't turn your case around.

Do as others have advised you MANY times in other threads you created: FILE A NEW CASE!

And prepare WELL this time!

Yes, DPNH, he did a lousy job of presenting his "love story" to the C.O., his evidence is full of contradiction and holes to fill, so he got denied. Anyone would know that if they spend enough time on this board reading posts after posts. No need to yell at the guy... Ever thought, how fortunate we all were to find VJ before or after we file our case... we would have made ALL those mistakes he did? I know I have made a bunch of rookie mistakes during this journey but with help from the brothers/sisters on this board, things got straighten out without too much pain and suffer :)

Andy777, I don't know your case, but the decision to refile is yours to make. I wrote a piece to your post last night but never posted. Regarding your situation, wait for the file to come back to USCIS. In the mean time, one way you can do is to contact your Congressman/woman, Senators, and ask for HELP or assistance. Most congressman/woman, you'll be surprised, would be eager to have their staff to assist their constituins with their immigration matters... :) Don't give up yet, I think your case can be reinstated if you get some help and guidance.

thanks chuckandkim for the support. i dont want to post over but i did having problems with reply on my last post. I just want to get advice more from different people. it's not easy at this time for me and my wife. We just want to get advice from people who had been through this before so we can make the right decision this time. sorry if i post too much
