Got My NOA-1 and Background check papers same day

WOW recieved my NOA_1 and now I know I will recieve a RFI concerning the new I-129f petition. I went ahead and requested a criminal background form from Calif. and recieved it also. On the instructions it says it is not to be used for immigration or visa and states a penal law concerning this. The only

reason I did this is to see if a problem I had 20 years ago is on my record. I called the local police in Modesto, Ca. where all this occur and the police clerk did a quick check for me just being nice and only came up with my only DUI and not the other assault that I know happen. I went thru a diverision program which I understand was if I completed all requirements and went thru a probation period this would not be a conviction on my record. Once I recieve the criminal background check from the Jusitice Dept. of Calif and nothing comes back except the one DUI should I even mention it on the RFI petition when they send it back. My reason for asking is the local police clerk and the county court clerk told me that most files get purge from their system after 10 years and they will not even have a record of it.

I have not been in any other type of trouble since and seperated myself from that type of life a very long time ago.

I have disclose all my past problems to my baby so she knows who I am. I do not want to lie about nothing but if a convicition is not on my record am I required to disclose this anyway?

Called US Embassy in Taiwan 6-13-06 5:01 pm Pacfic Time

Salve Going to Tiapei, Taiwan US Embassy to request transfer from Manila to Taipei 11-15-06

Salve's 2nd trip to Embassy in Tiapei. Our case has been requested to be transferred to Taiwan 11-16-06

11/23/06 I contacted 2 California and 1 Tennessee Senators concerning case in Manila

12/6/06 Case is sent from Manila to Taiwan.

12/27/06 Salved recieved call from Taiwan Embassy case is in office and packet in mail.

APPROVED January 24, 2007

Leave for USA Febuary 1, 2007

Married March 3, 2007 in the Smokey Mountains

INTERVIEW 6/12/07 AND APPROVED!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Mailed completed I-751 package 3.12.07

Recieved Notice of Action for Biometrics to be done 4.17.09 in Charlotte, NC.

9.4.09-- 10 year green card approved

Waiting now for citizenship

You do know that USCIS will only ask about the following crimes, right?

Domestic violence,sexual assult,child abuse and neglect,dating violence elder abuse and stalking

Homicide,murder,manslaughter,rape,abusivesexual contact,sexual exploration,incest torture etc etc

Three or more convictions for crimes to a controlled substance or alcohol not arising from a single act.

They are concerned about felonies, not misdemeanors. When you have a 'felony' conviction, you have done something bad enough that you are considered to be a criminal. Most of the time a DUI is a misdemeanor (unless you have hurt anyone) until #3.

You just need to know what you were convicted of, misdemeanor or felony. Misdemeanor, no problem. Felony, you are going to need to document your things a bit more.

2005-08-05 Called NVC. No record yet.

2005-08-11 NVC case sent to embassy. <--

2005-08-12 Called NVC. They said: ^^^^^

2005-08-15 Received NVC confirmation letter.

2005-08-19 Embassy opens mail and sends interview date!!!

2005-08-25 Doctor's appt.

2005-09-01 Pick up Police Report.

2005-10-08 Off to Bangkok! Anyone call a taxi?

2005-10-12 Interview date. Approved!!!

2005-10-26 Mod & I are flying home to Kansas City.

So I have a misdemenor, then I wont need documentation?

Plus it happened 12 years ago, dunno if its purged. My gf knows all about it. Its the matter of finding the criminal background check to submit with the petition.

Really??? That's good news then..... it means that Dave being caught with those pills he used to take in Brazil (that he had the prescription for by the way!!) won't matter too much then..... right? :unsure:

Latest steps:

10/26/2006- Consulate receives case (seriously, one month to receive the case?? BS!), and packet 3 that I sent even before they had received the case.

01/02/2007- Interview!!!!!!!!!!!!! Got a 221(g)

01/23/2007- Second Interview. VISA granted!!!

01/29/2007- VISA arrived.... no envelope though. I'm gonna contact them and see what happened this time!

01/31/2007- I'll have to send them one last financial support evidence.

02/01/2007- Evidence sent

02/02/2007- Evidence received by Consulate

02/06/2007- Consulate sends envelope!

02/07/2007- Envelope received!!!

02/10/2007- Flew to the USA!!!!!!

04/17/2007- Wedding day!!!
