Ive got a quick question. My dad just called me and told me that we got a letter from homeland security. I told him to open it, and he said that they are requesting 'proof' that my husband has a green-card processing in his name in order for them to process the I-765 EAD. I sent the following together as part of the AOS package, the Advanced parole I-131, the EAD I-765, and the I-485 Application to register permanent residence, i sent it all together, and thus AT THE TIME i did not have the I-797C Notice of Action on the I-485, now they are requesting that i send in a copy of the I-797C, and that they will begin to process his I-765 EAD within 90 days of receiving it. Why are they requesting evidene when i sent all the information together????? And Alfredo and i are going for his biometrics tmrw and on the biometrics letter it says that the biometrics is for BOTH the I-485 and the I-765, so what do you guys think i should do? Just go to the biometrics...and not send anything in? Because on the instructions for sending in the AOS package, it says that you can send it all in together, and now the want copies,.... which is going to push us back..... this happen to anybody....????? Any advice?????

April 10, 2009-Biometrics appt. done, in and out in 15 minutes

Nov. 18, 2009-Card production ordered

Send the copy of the NOA for the AOS.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Send the copy of the NOA for the AOS.

What address do i send it to? the chicago one.... the same 1 i sent my AOS paperwork to? or should i look to see what address the letter came from and send it there? And obviously if the letter lists an address ill send it there... but i am asking ahead of time because i do not have the letter in front of me...i will in about 3 hours when i drive home for easter break.

Yes, they got something mixed up. Since you did not have to send a fee for the I-765 (not needed when applied together) something got separated and now they want to see proof you filed the I-485. Doesn't sound like a big problem, just send a copy of the NOA from the AOS filing.

Yes, they got something mixed up. Since you did not have to send a fee for the I-765 (not needed when applied together) something got separated and now they want to see proof you filed the I-485. Doesn't sound like a big problem, just send a copy of the NOA from the AOS filing.

And I doubt it will push anything back. You will very likely get the green card first and the EAD will be a moot point. It happened to us. A delay in the EAD will NOT delay the AOS, but the reverse is not true.

Your mother called you as well to advise you of the same thing, you chose to ignore her. Apparently the same letter came for Alfredo at the family home you hastily moved from, that you chose to ignore. Quite possibly they want copies because you do not have any co-sponsors for Alfredo now & you do not have a job to support him. You only tell this forum what you want them to know, not the whole truth. Maybe you should resend new sponsor letters from your dad since hes the only one you will communicate with.

Beyond the "it happened to us," where are the statistics on which this claim is founded?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes, you all have missed something... The parents that were so supportive and would have DONE ANYTHING TO PROTECT U & ALFREDO, were deserted when they found info that was not favorable to this couple which is why there is a request for more proof.

BTW... So sorry to see that Alfredo's family over rides your own, taht you can not even acknowledge YOUR sisters 2nd birthday or Easter or call home to let us know that you were safe & that your mother is pregnant!!

ok if you got beef, take that $#it elsewhere. this is not the place to air dirty laundry, there are lot of people who come here looking for help and it annoys me that you use this forum to air your family grievance..it might have been cool the first time because you were angry or whatever but this is stretching it...not only is your post out of place, but its a complete waste of other people's time..!
