hello!!

i was researching a little about the poverty levels in preparation for filing soon.

i have both a 9-5 job and a small business on the side.. altho my 9-5 is WELL over the poverty limits, my business took a MAJOR loss which puts me just below the 125% poverty level..

questions..

I am reading that most of the time the I134 (fiance visa) looks at 100% and the I864 (spouse visa) looks at 125%..Does anyone know if the Jamaican embassy follows these same rules?

Do u "think" (i realize, no one will know for sure) chances are still good if the other 2 years 06 and 07 are not below the poverty level or if they see ur main source of income is still above the levels ?

Chica, if your main job puts you over the poverty level you're good. Don't worry about the other - look at the two jobs together, not each having to stand on their own. All they want to know if that you have enough income to support yourself, your kids and RJ. Make sense?

but thats why i am worried my tax return would show the combined amounts for example.. $38000 from work plus -13,000 from the business equals $25000, so this is the amount they will see on my return..

but if they look further, they will see that i just had a bad loss and am actually above the limits.. just wondering if THEY will look at it like that..

or if i just don't confuse the issue and just send in my W2 for 2008 instead of the return, but i am sure that would be cause for a RFE..

used to compute

poverty status:

* Money income

o Includes earnings, unemployment compensation, workers’ compensation, Social Security, Supplemental Security Income, public assistance, veterans’ payments, survivor benefits, pension or retirement income, interest, dividends, rents, royalties, income from estates, trusts, educational assistance, alimony, child support, assistance from outside the household, and other miscellaneous sources.

o Noncash benefits (such as food stamps and housing subsidies) do not count.

o Before taxes.

o Excludes capital gains or losses.

o If a person lives with a family, add up the incomeof all family members. (Non-relatives, such as housemates, do not count.)

Ok - I get your point. You will have your W2 from the main job so that would prove you make enough. Get transcripts from the IRS - they give them for free and then you will be able to see for sure.

a weight has been lifted.. i was like dang.. i guess i gotta wait till nxt year to file for the visa, even though i could be heading that way anyway i don't want it to be becuz of my earnings LOL

Quana, why don't your SO come over on his visitor visa and you'll get married, then AOS from there. Then you won't have to worry about the poverty level. He can get his EAD card while waiting and he would be able to work before you'll have your interview.

Quana, why don't your SO come over on his visitor visa and you'll get married, then AOS from there. Then you won't have to worry about the poverty level. He can get his EAD card while waiting and he would be able to work before you'll have your interview.

Rox you do know that this is Immigration fraud right? You cannot enter the US on a visitors visa with the express intent to immigrate. A lot of couples do it. However, they would then have the burden of proving that they did not know each other prior to him arriving in the States. It is extremely risky, and could set them up for unneccessary heartache. If he had a work visa or student visa I would second your suggestion in a heartbeat.
