Okay, so Lin and I were married here on Jan 30th. She signed her last name on the marriage certificate as her maiden one. We are about to file for the AoS and EAD etc.. She wants my last name. How do I go about doing that? Also, what do we sign her name on the AoS and EAD? Ahhh! So confused!!!

You will have to contact your local state court authority to see what they require for a name change.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

She can change her name by just applying for AOS in her married name.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I signed my marriage certificate as my maiden name but have had no trouble filing for my drivers license renewal, social security card etc, just using my married name.

I think thats a common thing and she should be fine

If she already has an SS#, then a name change is needed to be filed at the SS Administration. If not, then when you apply for the SS card, do so w/ your marriage license and do it w/ the married name.

I don't see any problem with it. When I married my hubby, my maiden name is written in our marriage cerificate and marriage license.

When I applied for AOS, I used my married name.

Either way, you would still submit a copy of your marriage certificate with her AOS papers to prove that she's married to you.
