Hello everybody! First of all, I would like to thank everybody for the useful information posted on this website. I found here the answers for many questions I had regarding the immigration process. I can truly say that you guys helped us a lot more than the lawyer we hired for handling our case.

My story in a few words: my American husband and I got married in November 2008. It was the happiest day of our lives. At that moment we were not aware of the difficulty of the visa process. I am still waiting in Romania for all this come to an end and finally go to USA and start the family life we are dreaming of. Recently we received the approval for I-130. We also filed the I-129F for K-3. We got NOA1 for I-129F on 16 March. At this point we have a dilemma: should we proceed with the CR-1 visa at NVC or wait for the approval of I-129F. from what I have read, the k-3 visa is faster and this is all that we want. We are aware that once arrived in USA, we should apply for AOS, but then we shall have the time for any kind of paperwork.

Actually, the question we have now is the following: if we decide to go on with the CR-1 visa and meanwhile we receive the approval for I-129F, can we go on with the K-3 visa?

if your I-130 is already approved, go with CR1. you will get a green card upon entry and save yourself over a thousand dollars for not having to go through adjustment of status.

Also, nvc doesnt take that long...you've already went through the longer wait (getting I130 approved). Use the shortcuts for getting through nvc and you should know of your interview date within a month.

i've seen people go through NVC in less than a month... If you have your NOA2 already, just make sure all your documents are in order so you won't get an RFE.

However if you already filed your I-129F, you can continue with the K3 and just abandon it if your CR1 arrives in US embassy at the same time as your K3. As mentioned already, CR1 is a superior visa.

Well, technically... we cannot decide for you. I've seen people get delayed in NVC, seen people fly through NVC... it depends upon your luck. Personally, I'm still undecided whether to file the k3 or not. So... it is really just a matter of chance and lots of prayer.
