Hi all,

I'm USC and will sponsor my wife, but I need my grandfather to be a joint sponsor to meet the 125% income above poverty level. I live with my grandparents, and they file their tax jointly.

From what I've read, I need to fill I-864 and my grandfather needs to fill I-864A since we're living in the same house. My questions are:

1. When my grandfather fill I-864A, he has to put his own income instead of their income jointly. Is that correct?

2. How should I count my household size in my I-864? Is it 3 persons, which is me, wife and grandfather? or 4 persons, including my grandmother?

3. What about my grandfather's household in his I-864A? is it 3 persons, which is grandparents and my wife? or 4 persons, including me?

4. My grandfather is retired from military and still receive his retirement every month. He also has another income since he's working for a private

company right now. When he files I-864A, does he needs to attach the letter from his current company and also from military? And what about

the pay stub? Does he have to submit pay stubs from current company and also from his retirement?

I'm so confuse about these things.. please help.. thanks.

You can each just file an I-864. Using the "a" is only required when you need to combine more than one income to qualify. Assuming grandfather qualifies on his own, use an I-864 for each of you. That way, your household size is two and your grandfathers is three, he, grandmother and your spouse. Yes, he states only his own income and backs that up with tax returns including all scedules and W2/1099 forms. This will make it clear which portions of the joint income are his. A transcript will not accomplish that.

This answer assumes a spouse and CR1 or IR1 visa category. I have no idea what is required for N/A visa your profile states you petitioned for. Please fill in your profile and timeline.

Hi, yes I file CR-1 for my wife.. Sorry I haven't filled my timeline, still try to figure how to do that :D.

pushbrk, so my grandfather doesn't need to fill I-864A? I thought he has to fill that form since we live in the same household.. So, both of us have to fill I-864? thanks.

Hi VJers,

Just called NVC, and they said my grandfather needs to fill I-864A because I live with him right now and need his income to meet the income requirement.

In my I-864 how should I count my household size? Pshbrk said it will be 2 which is me and my wife, but, what about the qusetion 21. g. in there? they ask: g. OPTIONAL: If you have siblings, parents, or adult children withthe same principal residence who are combining their incomewith yours by submitting Form I-864A, enter the number here.

. I assumed I have to put my grandfather there? SO my household size will be 3 (including my grandfather)? Please correct me if I'm wrong.

And what about this: Proof of their residency in your household and relationship to you if they are not the intending immigrants or are not listed as dependents on your Federal income tax return for the most recent tax year. What kind of proof that I have to submit to show them my relationship with my grandfather and that we have the same address? Do i need to send them our bills which have same address? Thanks.
