My wife's (USC) petition (I-130) has been approved a couple of days ago. Can i now apply for a SSN or do i need to wait for EAD to be approved? I want to apply for a SSN not for work but for a drivers license.

Timeline

As far as i know apart from K1/K3 , mostly you wd need EAD to be in your hand before you can apply for SSN. You can check up with ur local Social security authorities whether an I-130 approval wd suffice or not. Thanks

March 13, 2009 : Checks Cashed
March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.

Thanks for your quick reply christera22. I asked if i could apply for SSN coz i saw a couple of K1 timelines that says they applied for SSN. I think those who have approved I-130 should also be allowed to get SSN. Those with K1 visa holders wont be able to use their SSN for work til they get their EAD just like everyone else. Are they given "Non-working SSN" which they could use to get ID's or DL?

I think you have a BIG problem. Your wife isn't allowed to adjust status as you guys were married in the Philippines.

Hope I'm wrong.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

in order to be eligible to apply for SSN you MUST be work authorized... an I-130 does NOT provide that...

Timeline

You will not be able to get a SSN until you have a EAD in your hand. You should have filed the AOS along with the I-130 and then you would have had the EAD and AP and maybe even your interview date by now.

But until you have a EAD you can not get a SSN or State ID as you need evidence of your approved stay and a I-130 does not get you anything, it only establishes your eligibility to file for a Immigrant visa or Adjustment of Status without having to wait for a visa number to become available (immediate relative) or one of the catagories that have to wait for a visa number to become available.

It is the I-485 (AOS) that gives you the right to live and work in the US.

I-130 is not a visa to enter or remain in the USA. It is the 1st step in getting a immigrants visa or doing AOS from within the US. If you had filed the I-130 along with the I-485 then you would have had your EAD by now and would have been able to get a SSN.

K1 visa holders are allowed to apply for a SSN because some states require a SSN in order for people to get married.

eligible to be authorized and actually being authorized are two different things.... SSA will NOT accept a SSN application until you are actually authorized... K-1 has special dispensation (something like authorized incident to status)

Maybe in your State they will, but not here in MA you need a SSN and either EAD or Greencard to get a State ID or DL.

If you had filed concurently then you would have been so much closer to getting the EAD and interview, all you have done by filing the AOS later is to prolong the wait time.

not so much anymore.... most states have tightened up the acceptable ID standard in anticipation of the enactment of REAL ID.... unless the authorized stay period is one year or more, most states will automatically exclude you from a DL.
