Hello,

I need help filling out the affidavit of support: I am helping my mother because she is not so good at filling out forms but now I need help with the paper work. My mother is a U. S citizen and everything has been done. My mother petitioned two of my siblings. They have been assigned two different case number. The last letter we received was to fill out the affidavit of support for each one. In the form it says that she has to reach a certain amount of income to support them. My mother is self employed and can't reach the amount required. My boyfriend volunteered to sponsor for both cases, this means that he has to fill out another I864 right? My boyfriend and I live together but not with my mother. Also, I have a younger sibling that lives with my mother and she is willing to sponsor too. She will need to fill out an I864A, right? Please let me know.

I have another question, it says that in order to be a sponsor you must meet 125% of the poverty line all by yourself, unfortunately my boyfriend can't so I spoke to my father in Nicaragua and he is willing to sponsor of course the siblings that are coming to the USA. The question is, can he sponsor them even though he is out of the country?

If he is out of the US, he cannot co-sponsor. Co-sponsor means that he/she is willing to support the beneficiary here in the US. US government dont want to accept a public burden in case he/she dont have work yet. But you can add all the household income to meet the 125%.

Thanks so much. I appreciate your answer. Unfortunately my mother went to a public notary and only an I864 form was sent out. My mother claims that the notary said that the I864A is not required. But I don't think that's true because according to the Poverty guidelines she needs to meet 125% and if not she needs a sponsor who makes 125% all by themselves then combine it with hers. Since only one form was sent for each case, will the case be denied or will we receive a letter stating that we need a sponsor? If you have any idea, I would like to hear your thoughts on this.
