My mother has agreed to help me with the AOS. Should she fill out the I-864 or the I-864A or both. I'm just a tad bit confused. Also I am unemployed at the moment and have been for the past 3 months because I was finishing school and finding a job here in my city is very hard. Will that hurt my case?

Unless you and your mother live together AND need to combine your incomes to qualify, she provides an I-864.

If your mom is a resident at the address which you have used to fill out your forms, ie you live with your mom then she should fill out the I-864A. If you have two separate addresses she should fill out I-864. Don't forget to inclose a proof of relationship in your I-864 package (for example inclosing your birth certificate to establish you mom is related to you maternally).

The fact that you have been a student and are without a job should not affect your case as long as you mom has enough income to sponsor your wife.

Thank you for the correction. I did not understand that part from the instructions. My household member's income was enough to qualify without combing mine and she filled out the I-864A. Thank you for the correction.
