hi,

please someone help me whoever entered the US by a K3 visa :( ...i am a K# visa holder and im here in the US already.i dont know what to do next anymore, immigration lawyer here in the US is so expensive so most of the time i just rely on researching on the internet.

i really do appreciate it if someone can help me on this site.

do we still need to pay the Immigrant visa fee($400) in NVC if i will adjust my status soon on USCIS???we already paid the $70 for the Affidavit of support in NVC.Also theres a typo error on my name in the I 130, what should i do?

Your questions aren't very clear, but if you arrived on a K3 visa then you will still have to pay $1010 to adjust status ($930 + $80 biometrics fee). Read the guides above for Adjusting Status from a K visa.

Jan 2008 filed I-130 to USCIS and paid $355.00

Feb 15, 2008 I-130 approved

Feb 26, 2008 filed I-129F to USCIS

May 13, 2008 I-129F approved

May 2008 my husband received the AFFIDAVIT OF SUPPORT FEE BILL of $70.00 from NVC

May 27, 2008 received a letter from NVC about the CHOICE OF ADDRESS AND AGENT FORM

june 2008 sent back the form

June 27, 2008 got an appointment confirmation from NVC

June 30, 2008 medical at st. lukes

July 02, 2008 interview at US embassy philippines

Aug 1, 2008 visa on hand

Aug 4, 2008 CFO seminar

Aug 7, 2008 my husband received again a IMMIGRANT VISA PROCESSING FEE BILL of $400.00 from NVC

Aug 10, 2008 enter US/LAX

April 2, 2009 paid the $70.00 AFFIDAVIT OF SUPPORT FEE to NVC

Thats my TIMELINE at the moment. I didn't adjust my status yet due to financial also and I don't know when to file the ADJUSTMENT OF STATUS of a K3 visa holder.

My question is do i still need to pay the IMMIGRANT VISA PROCESSING FEE BILL OF $400.00 that NVC sent us if my plan is ADJUSTMENT OF STATUS?

Since you interviewed for the k3, and entered the US, you didnt not even need to pay the aos(affidavit of support) fee bill to nvc unless you plan on going back to phil to interview for the CR1.

At this point, NVC is NOT processing your adjustment of status. So, NO you do not need to pay the CR1 visa application fee to NVC if you are going to do adjustment of status here.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

You need to fill out the AOS application forms (I-485 and I-765 and I-864) and send those to your local district office for processing, otherwise the CR1 process will continue thru NVC and you will have to return to the Phils for your visa interview.

Include a photocopy of the I-130 and any fees you have already paid with your package, so they know to discontinue the NVC processing.

We didnt pay yet the $400.00 for the visa processing and we will not pay it anymore coz our plan is to adjust my status but for the moment is we cant yet...When is the best time to apply for adjustmentof status?

You can file for the employment auth first, before filing for Adjustment of status.

BUT please note:

Apply for Adjustment of Status (AOS). You should file before the K-3 Visa expires. If you have not filed for AOS and your K-3 expires, you will be considered out-of-status until you file.[/b]

No, you don't have to pay $400 to NVC...Just call them and let them know that you are in the USA and will adjust your status to USCIS...It happened to me too...

08/14/2008 - I 130 sent

11/21/2008 - I-130 upgraded to USC

12/17/2008 - I-130 approved

12/30/2008 - I-485, I-693, I-864, I-131, I-765 sent

01/10/2009 - NOA for I-485, I-131 received I-765 rejected (old form)

01/12/2009 - I-765 resubmitted

01/14/2009 - received letter for biometrics appointment on January 27

01/20/2009 - NOA for I-765 received

01/21/2009 - biometrics walk-in

03/10/2009 - CRIS e-mail I-131 approved

Yes, you can apply separately for the EAD without applying for AOS at the same time, however you will end up paying the processing fee twice, because the EAD application fee is now included in the AOS fee of $1010. If you apply separately, the fee for EAD is $340, which I'm not sure if that includes the $70 biometrics fee or not. There used to be an additional charge for biometrics, but I don't see it mentioned on the I-765 form now.

PLUS, if you wait too long to file your AOS, your medical from the K3 could expire, and then you'll also have the additional cost of having another medical exam done. In some areas the fees for that can be over $400 on top of the $1010 for AOS.

So if you add it all up, waiting to file AOS because you can't afford it right now makes no sense. If you have to borrow the money from family and/or friends to do it now, it will cost you much less than waiting to do it later will.

I agree. Get the money somehow or else it will get more expensive and/or you may have to go back and do everything all over again.

I would have hoped that you two discussed these costs when you first applied. See if you can get a family member to loan the money or go to the bank and take our a personal loan or home equity loan.

No, you don't have to pay $400 to NVC...Just call them and let them know that you are in the USA and will adjust your status to USCIS...It happened to me too...

My husband called them already and they told my husband that file on Adjustment of Status in USCIS.When did you filed your Adjustment of Status?is it a long process?

My visa will expire mid nxt year.Im just waiting for our 2nd year marriage anniversary maybe to avoid 2 year conditional GC coz if that will happen we need to pay again for the removal so another fee again.Our anniversary is on november this year, is it ok to wait that long?
