Hello Everyone. Finally go reunited with my fiance and now husband. We are soo happy.... After 2 years since we filed 7/28/07 we received our visa on August 4, 2009... don't give up. if you know USEM is wrong fight for it... We did...

HI. I'm confused with your post, sorry. This is how I understood it, your fiancee went to the US on a tourist visa, am I correct? If so, would not the embassy know the actual date of your fiancee's departure from the passport itself? Philippine Airlines boarding pass may help but I think it is not needed because when you depart from the US on a tourist visa, you return to them a white slip (I forgot what it's called, it begins with I-) on the airport. And, when you get back to the Philippines, they also put a stamp on your passport stating the date of your arrival. So, even if the pre screener incorrectly wrote the date of his departure, they can still verify that on his passport.

I don't know if there is anything you can do at this point. If they have reviewed all the evidence that you have submitted, and still not changed your fiance's status, I think there is little left for you to do other than wait for his ban to pass. Even after the ban passes, you still have not satisfied them that you were not already married. Pehaps you can consider getting married in the Philippines, and pursuing one of the other routes, such as K-3, or CR-1/IR-1.

Good luck, and I hope things work out for you two. You have to find even more patience to get through this.

things are getting too confusing...too many angles to review...and a very long time of waiting!

Instead of waiting forever and keep explaining to them, but i doubt if they would admit their mistakes...they will...and will always find a reason for that.....

Go for the Spousal Visa!

Yes we provided the passport with the stamp but still got the wrong date. So we are being punished for their mistakes! So I took it upon myself to do the research and had Philippines Airlines write letter.

So, you have to move on.....and dont make them frustrate you! you are wasting your time with them!...Go...go..go....move! LOL

Yes we can refile in 3 to 4 months. but that means we are giving them the satisfacation that they did not make a mistake! and then the lady at usem said we can file for a waiver... we dont' need to file for a waiver because we have the evidence that my fiance did not overstay. a waive? and then what? waste more time waiting and waste mor money... :bonk:

You should also add a copy of his departure and arrival stamp: entry stamp in the US and arrival stamp here in the Philippines.

I think the letter from Philippine Airlines will be sufficient enough. If they dont' believe it they can always check which they never did... :bonk:

Sounds like the best thing for all...your peace of mind and their satisfaction. THEN once you get to US start a movement to bring these mistakes to to light so others don't run into same problems that you have.

I just don't understand. During the interview, we were only asked 2 or 3 questions about our relationship... The consulate knew that our relationship is real. but yet we are accused of overstaying... What about those people that are doing fraudulent..and still got approved??? It's just not fair.. :blink:

CALL one of your senators. One should have a immigration specialist on their staff that will be happy to help. They can get down to the nitty gritty.

Mine has helped a LOT more than once.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Thank you.... I did write to my senator because after our lawyer wrote to USEM they did not respond until 7 1/2 months later. USEM finally responded and emailed me however, USEM hasn't responded to the senator. Maybe USEM did not respond because USEM already emailed me... But I'll try again and give all the info to the Senator. Wish us luck.

I am also very much in favor of getting BOTH of your Senators involved, and your Congressman too. Send them ALL of your evidence. Make a strong case for yourselves, just like you would make a case to the USEM. Then, keep in touch with their offices. Email them every week and ask them for an update on your case. Don't give up! Be persistent! What the Embassy is doing to you is WRONG!
