Travel whit advance parole but expired i 94

I have a question.

I have a ap and a ead.and my aos is pending.

I need to travel to the netherlands.

But now i see on my I 94 it expired on 29 november 2008.

And i need to travel 24 april 2009.return 13 may 2009

Do they consider this as an overstay on my i 94.

What can i do and is it safe to travel on my advance parole.

I hope somebody knows the right answer, so many different ansers when i search the internet.

Some say its no problem to travel others say not to travel.

I dont know what to do anymore.

Your I-94 was given to you when you entered the U.S, it was given to you so that you had enough time to apply for the AOS stuff, i am assuming you came in on a K-1 fiance visa, but even if you didnt, once you apply for the AOS stuff, and it is being processed, you are fine, even after the I-94 has expired. You can leave the country because you already have our AP, just take a copy of your paperwork saying that your greencard is being processed just in case, obviously your passport, and a copy of your marriage certificate if you came over on a k-1,

someone else feel free to chime in, but that is myunderstanding of everything.

I-129F NOA1 : April 5, 2008

I-129F NOA2 : April 28, 2008

NVC Left : Aug.18, 2008

Packet 3 Received: Sept. 3, 2008

Interview Date : Dec. 18, 2008

APPROVED!!!!

Dec. 19, 2008- Alfredo comes home!

Jan. 5, 2009: Alfredo and I become husband and Wife

March 10, 2009 AOS paperwork sent, will wait for it to arrive via tracking #

March 12, 2009 AOS paperwork arrives in Chicago

March 23, 2009 NOA1 for I-485, I-131, I-765

March 30, 2009-Biometrics letter received, appt date April 10th @11am philly office

April 10, 2009-Biometrics appt. done, in and out in 15 minutes

Nov. 18, 2009-Card production ordered

Yes, you can travel. The I-94 has nothing to do with it. That was your previous entry, you have filed for AOS and have AP. No problem. Bring with you your passport (of course) your I-797C receipt for status adjustment, both pages of your AP...oh, and a plane ticket! Have a good trip!

Your I-94 was given to you when you entered the U.S, it was given to you so that you had enough time to apply for the AOS stuff, i am assuming you came in on a K-1 fiance visa, but even if you didnt, once you apply for the AOS stuff, and it is being processed, you are fine, even after the I-94 has expired. Correct! For immigration questions, ask at this site. Your status now is "AOS Pending" it is absolutely NOT considered an overstay of your I-94.

I came her on a k1 visa.

So it looks like i'm good to travel.

Do they take the old I94 out.

And do i get a new one at re enter the us.

When you re-enter you will give both copies of your AP. They will stamp them and give you one back. I do not know if they will give you a new I-94, since you are in the process for permanent residency it may not be required

The airline usually removes the I-94 when you check in. If they don't.... no big deal. It will be removed when you re-enter and replaced with a new one.

Submission of AOS does not equate to automatic approval! The poster's correct status is "applicant for adjustment" -- or, more simply, "adjustment applicant."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
