Hello Everyone,

I am a US Citizen and I married my husband back in october. We filled our papers in the middle of february, his biometrics appointment was on March 16, he is getting desperate beacuse his Visa expires on April 14, 2009. He wants to know how soon could he expect his work authorization and after that the interview. Thanks for your responses.

04/26/2006 Met in the Dominican republic

10/15/2008 He arried in NYC with a Visa (we visited each other)

10/25/2008 got married in NYC

02/16/2009 Packaged received at uscis

02/23/2009 Notice date

03/16/2009 Biometric appointment

ok pls tell him not to be impatient. At least not in the matter of AOS. EAD or work authorization come in generally within 90 days of AOS submission. The interview cant really be speculated. It differs from person to person & case to case. Its generally after 15-22 days after biometrics you get a notice of action 2. NOA 2 generally have messages like EAD card production ordered. NOA 2 has case numbers with which you may be able to track your case online sometimes, if they have uploaded ur case. If not dnt worry. NOA 2 in may case may also have final interview date which may be anywhere from 1 month-1.5 month or more. Hope this helps. Try to look at timelines of people who has passed the AOS. Thanks

Package Delieverd at USCIS: March 05, 2009
March 13, 2009 : Checks Cashed
March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card
Removing Condition
3/25/11 - Received reminder from USCIS to file for ROC
5/6/11 - Sent I-751 Packet to CSC via usps
5/9/11- Package delivered to csc.
5/11/11- Check cashed electronically by CSC
5/16/11- NOA 1 received
5/27/11 - Biometrics letter received.Scheduled on 06/06/11. Case Online
6/6/11 - Biometrics done
9/6/11 - Approved.Card Production Ordered

His visa is not longer valid, K1 is one time use visa, if he used the K1. It doesn't really matter when it expires. He has to be patient and to continue waiting for the work authorization.

yes, I saw other post, he is adjusting from a visitor visa. :blink:

I sent my AOS documents about 2 weeks before you did (end of January 2009) and just received my EAD two days ago (April 11 2009). And I am not sure if this would make you feel better but... I had some problems with my biometrics (had to do biometrics twice, each was about one month apart) and I thought it would delay the whole process to get AP, EAD and GC for much longer time, but apparently that was not the case (I received my AP and EAD within a reasonable time frame). So I am pretty sure your husband will receive his EAD in a few weeks (unless you get an RFE).

Oooppsss... didn't notice that he came on a visitor visa. Thought he was adjusting from K-1. I can't say anything about the reasonable time frame for the EAD and GC then. Sorry about that :(
