About I-864

Hello everyone,

I am wondering about I-864.

I understand that if I apply for my parents I would have to make enough to cover for 4 dependents( Me, my husband and my parents)that would be a total of $ 27’562 listed by the poverty guide line. At this point we don’t even come close to that income.

My parents would not live with us, and since they are both over 63 years old they receive a small government retirement pay from there home country.

Can we use this income of my parents in the I-864???

Reading the Instruction for the I-864 below it does not appear that their retirement income can be used toward satisfying the I-864 income requirement. See below from I-864 Instructions, page 2:

Can the Intending Immigrant Help Me Meet the Income Requirements?

If certain conditions are met, the intending immigrant's income can help you meet the income requirement. If the intending immigrant is your spouse, his or her income can be included if it will continue from the same source after he or she obtains lawful permanent resident status. If the intending immigrant is another relative, there are two requirements.

First, the income must be continuing from the same source after he or she obtains lawful permanent resident status, and second, the intending immigrant must currently live with you in your residence. Evidence must be provided to support both requirements.
