I-134 or I-864?

Alright, I'm officially confused. In the packet that the embassy sent my husband to fill out, they wanted him to return form I-134 filled out by the sponsor, for the K3. When I paid the AOS fee online and went to the Affidavit of Support page, it seemed to be saying that I need to fill out the I-864 for the NVC. Am I supposed to fill out both of these forms, the I-134 for the embassy, and the I-864 for NVC? Or can I just fill out one or the other for both?

I am still trying to find a joint sponsor, since I am a full-time student and not working. I am assuming that scholarships, grants, child support, etc. do not count as earned income, since I don't have to file taxes for them, but should I include that income on the AOS forms?

Which route are you guys doing? The k3 will be the I-134.

If you are following the CR1, you need to do the 864.

I guess if you already paid the AOS fee, then I guess you are doing the CR1.

Focus on whichever route you are taking. The embassy will get the 134 from your husband for k3, if you go CR1, NVC wil forward the 864 to them when they complete your case and send it to the consulate.

Will he attend both interviews? The k3 and the CR1 to follow? Or Does your consulate allow K3 interviews to be flipped to CR1's?

I hope all of that made sense :)

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

I think it made sense! I didn't realize that they were processed separately, as K3 and CR1. I guess we are pursuing both? We had intended on the K3, and I thought that's what I was following the path for, haha. So if we just want to pursue the K3, then all we have to do is submit the packet he received back to the embassy (with the I-134) and not bother with NVC anymore?

And if we want to pursue both (since I already paid that nice $70 non-refundable fee) then I send the I-864 to NVC along with all the supporting paperwork. Right? Or am I completely off base here? :)

This is very straight forward.

I-134 is for NON-IMMIGRANTS AS IN (K-Visa interviews at consulate)

I-864 is for IMMIGRANTS as in (CR-1 and IR-1 visas AND when a K-Visa holder adjusts status in the USA)

In K-3 case IF you are keeping both visa petitions moving you file I-864 along with a fee to NVC and use I-134 at the consulate IF you interview for a K-3.

If strictly perusing a K-3 and planning on adjusting status with it's added costs, you will be using I-134 at the visa interview and sending I-864 to USCIS when you adjust status.

If both I-130 and I-129F were approved at the same time, seriously consider keeping the I-130 moving through NVC and respond to I-864 and DS-230 packets from NVC, this will save you the time and aggravation of having to file for a green-card (AOS) from a K-3 visa.

For the most part CR-1 tends to take a bit longer than K-3 to get if you prepare for NVC when they request I-864 fee, and Visa fee, as well as documents requested by NVC. In many cases the CR-1 petition reaches the consulate just before K-3 interview, which causes K-3 to get dropped and the interview becomes a CR-1 visa interview.

K-1:

I-129F: $455

Consulate: $131

Adjustment Of Status: $1010 I-485

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

Adjustment Of Status: $1010 I-485

($1496)

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

I see many posts from K-3 holders stating, "Wow this sucks, I am stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

K-3 was developed at a time when CR-1 was taking much longer that today, NVC has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

You've got it right but the next thing NVC is going to want after the I-864 is a $400 immigrant visa fee. So unless you want to waste a stamp for the I-864 and $400, just ignore NVC at this point.
