I am in the middle of filling out the AOS for my husband but I have a concern.

I graduated in 2007 and moved back to my country for a while to be with my husband.. I didn't start working until October last year- my income for 2009 is well above the required income but my tax returns for 2006 and 2007 don't meet the requirement at all (I was a student at that time) however 2008 is almost there since I worked for only a few months. Now I have the employment letters statting my annual incoem for 2009 which is well above the standard but do I need to get a joint sponsor for the 2006, 2007, and 2008 tax returns or the employment letter for 2009 would be sufficient???

Marriage January 23, 2005

USCIS

August 14, 2006- I-130 Sent

September 22, 2008- NOA 1 Received

September 17, 2008- Became a USC

September 18, 2008- Upgraded I-130

March 20, 2009 - NOA2 (email)

March 25, 2009- NOA2 (hardcopy Received)

NVC

April 3, 2009 - Case Number Assigned

June 5, 2009 CASE COMPLETED AT NVC

June 9, 2009 Interview Date Assigned

July 16, 2009 Interview AP

August 24, 2009 DOS Operator said "VISA HAS BEEN ISSUED TODAY" Alhamdulillah

August 26, 2009 call from embassy to PICK UP THE PASSPORT :-)

August 27, 2009 Picked up the passport... woohooo!!!

September 9, 2009 US Entry InshaAllah

October 13, 2009 SSN and green card in mail DONE WITH USCIS until husband applies for his citizenship!!

The journey of 4 years, 8 months, and 3 weeks has ended!!!

only opinion that matters is NVC... go with what you earn and if they need something additional they will tell you...

i agree, just send everything you have for 2008. and hopefully they will not ask for anything regarding two previous years.

Dated since 2004, 10/22/2008 Married in NY, wife left the country, returns on 01/06/2009 as a visitor (granted stay until July 2009)

01/15/2009 Sent I-130 package for CR1 to Chicago Lock Box, 01/19/2009 USCIS Chicago received the application

01/26/2009 USCIS sent out NOA1, 01/28/2009 Moneygrams Order cashed

02/24/2009 Case is in Vermont Processing Center (told by the USCIS by calling the free phone line)

03/02/2009 NOA2 mailed, application approved!!!! (47 days since we mailed I-130 package)

03/05/2009 NVC Received Case / Case number assigned

03/12/2009 DS-3032 / AOS fee bill generated and e-mailed to us, 03/12/2009 I e-mailed and snail mailed DS-3032 and paid AOS fee bill online

03/18/2009 NVC received DS-3032 and it was entered into the system (I never received email confirmation)

03/20/2009 IV Bill generated and I paid online

03/30/2009 Sent I-864 package to NVC, 03/31/2009 Sent DS-230 package to NVC

04/01/2009 IV fee shows unpaid, 04/03/2009 documents are under review (confirmed by operator)

04/06/2009 IV Fee finally shows PAID, 04/07/2009 AVR system says that IV bill has been processed, "instruction package" received by email

04/08/2009 AVR system says "NVC received your documents on April 3...", our case is under review...

04/10/2009 RFE issued for DS-230 Part I, but AOS accepted

04/14/2009 found out the exact issue with DS-230 and sent the response using Chris Parker's RFE shortcut and later in the day received an email checklist for RFE

04/15/2009 RFE response arrived to the NVC facility, 04/20/2009 RFE response received by NVC

04/23/2009 CASE COMPLETED, 06/02/2009 VISA RECEIVED

When I was still applying for CR-1, they reviewed my husband's financial status based on the current or latest income and the previous ITRs for reference (the previous years barely met the required household income).

Then on my interview, I brought the latest financial documents (to prove that we're way above the required income due to increase in non-taxable compensation during the processing of the visa) and they computed the income again based on it.

You will do alright, good luck!

Thanks everyone- I am going to send out 2006, 2007, and 2008 regardless the fact that I didn't have much income except that I was working part time as a TA in university- hopefully it won't be much of a trouble! In the meantime, I will look for a joint sponsor too!
