RFE packet sent to Chicago, instead to MO!

Hi, everyone!

I'm so damn pissed right now...

Yesterday we sent the RFE for AOS packet to Chicago. I didn't read that red RFE Notice carefully enough - they say you MUST sent the packet to Lees Summit, MO.

We called the post office, USCIS office and they told us we have two options:

1. wait and check the case status everyday - maybe the people over there will send it to MO, or

2. send another packet to MO.

We could send another packet, but we have only copies. We don't have the oryginal form of my joint sponsor's I-864, neither his tax returns. We would have to do ask joint sponsor to send it to us again...

What should we do?

We don't have much time though. Since the RFE Notice we have only 30 more days left - we got it Feb 11.

If I were you I would send the copies of RFE packet with a cover letter explaining your situation to MO office. That way probably MO would contact Chicago to pull the originals and you wold have responded to RFE within deadline. Do not play the wait and see game -- it's probably risky plus you will not have peace of mind.

Those instructions are key.

I would only suggest a wait and see holding pattern for the moment - it is entirely possible the Chicago folks will forward your misdirected package to the correct place.

Presumably you included the original RFE notice with your response yes?

Today we had InfoPass and asked about this situation the immigration officer.

She said that our packet should be send to MO, but she can't say when. It depends when they will open it, check it and then forward it to a correct place.

We asked her what should we do with this pink RFE Notice, which was sent to Chicago Lockbox. She simply said we should copy it on a pink piece of paper and pretend it's oryginal!

I'm very confused and not happy with this idea. I don't think it will help us. I think we will get in trouble for making a fake oryginal. People from MSC will find out somehow, when they get this second packet, that we submitted TWO pink RFE Notices! I don't want any questions about that, I don't want to be in trouble. We can't even prove that the immigration officer suggested that - we don't know her last name, we don't have it recorded.

What should we do? We have oryginals now, my joint sponsor sent everything back to us, we have signatures, we have everything except this freaking pink RFE Notice.

Make a copy (white paper is fine) and add a letter explaining the situation. Do not attempt to "forge" documents. I am surprised the USCIS person told you that.

Send it to the correct address.

They need the RFE so they know what is suppose to be in the package and what it was for.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
