Anyone had a child back in Canada for school and Removing Conditions at the same time?

Timeline

This is entirely theoretical at this point. We start the Lifting of conditions next Nov (our GC's expire Feb/10).....I am seriously considering sending my daughter back to Canada for this coming Summer which shouldn't be a problem........but if we switched and sent her back to her old highschool for a semester Sept to mid-Jan with visits back home to the US several times during that period for Thanksgiving and Christmas.

Any thoughts on how Immigration will regard a student (albeit highschool) residing otuside the US? This situation has likely occurred many times before...

I'm unsure but if the standard test of attachment is applicable, it may depend upon where she would be residing.

Is this a boarding school or would she be living with family?

Family

If your daughter is living with family in her home country and attending school there, then it would seem reasonable that she could be viewed to have abandoned her status.

Not to change the topic, but given this situation, why does your daughter need permanent residency? Canadians can visit for up to 180 days at a time, which covers any non-school period you like. When college rolls around, she'll probably wish to attend in Canada anyhow given how she feels about high school (and you might wish to pay the lower tuition). The only problem I see is acquiring a summer job in the US.

It's something for you to think about.

Thanks - tough situation with a teenager who doesn't like where she is at the moment, but in future will probably want to attend college here in the States so getting that 10 yr GC will just be helpful. Since posting this, I've re-thought and realized that a summer visits and vacation visits are going to have to be enough and then when she reaches 18 if she wants to make some kind of decision one way or the other, she can do that. Thank you for the comments though - i agree that it would constitute abandoning her status
