My husband is a US citizen. We got married on April 1st and is now filing I-130 and I-485. In the instructions of I-130, it says that we need to provide documents showing joint ownership or property, a lease showing joint tenancy of a common residence... or any relevant document. Right now we don't have a joint account and we are not living together as we are still waiting to hear from the Co-op that we applied for in Feb. And for the affidavits, we have only been married for a few days. His mother and brother would only be able to make statements about seeing us before our wedding and on our wedding day. I have 2 questions:

1. Should I write a statement explaining why we haven't lived together yet?

2. Do I need to have affidavits or is the marriage certification and photos good enough.

1. You can - but can't you wait to file till you are living together?

2. In your case, you will need more evidence, not less.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

2. In your case, you will need more evidence, not less.

1. You can include the copy of the co-op application if it has both of your names. If you guys are not in a big hurry then I would advise you to wait to have some joint ownership before you send your application. If you can't wait then write a note to explain the situation.

2. Yes, affidavits, pictures, passport stamps, ticket stubs etc. Anything you can use to prove that it has been an ongoing relationship. Btw, you can also create a joint bank account pretty quickly.

Hopefully by the time you have your interview you would be living together and would be able to bring a proof to the interview.

We are getting married in May and I'm thinking ahead to filing the paperwork we will need and what I should be getting in order now.... I own the condo we live in and only my name is on title right now (bought the condo long before I met him). If I record a grant deed adding his name to the deed would this suffice for this item?

You can use your mom and brother as affidavits for being at the wedding and any type of relationship they have witnessed thus far. Any accounts you can get in both your names before the interview would also be good. I would file and continue to gather evidence for the months you are waiting for your interview.

That is what we did (well, in MA it's a quitclaim deed, but same idea). You may want to wait until after the marriage, however, because there may be tax consequences to deeding the condo to someone who is not your spouse (or not, depending on your situation).
