My wife's case had an RFE on I-864, which I already send what the asked for. It took my about 35 days to gather what I needed.

My questions is, during those days, does that RFE stops the entire case or do the other forms still remain active? In other words does I-485, I-765, I-131 stop also or do those remail active independent of the RFE on I-864?

I just wanted to know because we want to know if she will get her Advance Parole to leave the country and return, which I believe Chicago office shows between 70-90 days to get it, meaning next month in May. Or will the RFE stoped the process.

Thanks, hopefully someone will have an answer.

08/09/09 AP letter used to re-enter the U.S.

08/19/09 Interview completed. Results in two weeks. ( I think we got it)

08/24/09 Letter in the mail stating Interview Approved. Welcome to the United States!

an RFE on the I-485 stops processing on ALL pending applications for interim benefits that are based on that application. They will stay suspended until such time as the I-485 resumes normal processing.

Sorry but you are wrong.

We got an RFE, but that did not stop the processing of the Advance Parole or the EAD.

We gott the Advanced parole approved at just over 90 days and the EAD 2 weeks later, still waiting on the Green card.

There is no contradiction - even your RFE notice tells you processing is suspended on EAD/AP until such time as they receive a response. In most cases (over the years), when you respond to the RFE quickly, any delay caused is minimal.

Irrelevent information, not necessarily connected. If you received the EAD and AP before responding to the RFE, you win.

Otherwise you just got your documents at different times, it happens. In our case we got the green card approval, then the EAD and AP came exactly the same day and then the green card. Most often people receive the EAD and AP first anyway

Check your RFE letter. If the RFE does not affect the other documents it will say so.

When you think about it, it is really quite simple. You filed all forms together and paid ONE fee. The fee for the I-485 includes the I-765 and I-131 IF FILED TOGETHER. This means if the I-485 is invalidated or put on hold by some error, then all doucments based on that single fee are affected. The I-765 and I-131 in this case are subject to the processing of the I-485. It is NOT vice versa. I received a rejection on my I-765 because I downloaded the forms too early in the process and the form expired before I sent it in. They sent back my form with a letter saying the rejection of the I-765 DID NOT affect the I-485. It was NOT an RFE and did not require me to do anything. Why would it? In this case the I-765 was a "free" option. The I-131 is also an option. The I-485 is not an option and the whole premise of your filing the other two are based on that form in this case. It is the "downside" of saving the money to file them all together.

I am sorry to say that most of your responses sound like "know it all" and you hardly ever give any hope to the posters. It would be more constructive if you can offer suggestions on what they could do rather than remind them of their misery and your superiority (common across your responses). Just go and read all of your responses in last 2 days and see the tone and content. And don't try to play the card that you're just being honest and not sugar coating.. there are ways to deliver bad news.

Actually there was confusion. The OP stated he had conflicting answers I merely explained why the situation is. I have no idea what "on time" means. My post did address his questions.

What I dont like to do is go into threads and criticize other posters for their answers which gives NOTHING to the OP or answer his question. I already did provide some information based on research. I didn't just crib about the OP being not as great as me. What a sick mentality you have!! I won't grace you with any further discussion.
