Hi,

I was wondering about the advanced parole so that I can travel while my AOS is being processed. I can't tell if its something that is quite hard to get or merely a formality. I don't have any trips planned in the near future, but was wondering if I should apply in case I have to go home for a family emergency. Do I have to have a specific trip in mind when I apply or can I apply just in case I feel like traveling? How long does it take to process?

Any advice on this topic?

Advanced parole is impossible to get - there is no such thing.

Advance parole is considerably easier, it just takes a while. Specific travel plans are not required. But it's hardly a mere formality, as you'll find out if you leave home without it.

WE applied for parole on Feb 10 2006 and were approved 2 weeks ago.....My wife's Mother is in hospital, so we called USCIS and they said to send a letter explaining circumstances adn be sure to send it ATTENTION to Expedite Dept...We are not sure if this helped, but we got it...!!!!

My AP was delayed due to an RFE for something else. In itself, I dont think it is that hard to get, just provide an explanation, saying that you would like to travel. Certainly you must not leave the U.S. without either it or an approved Greencard.

As for if it is worth getting in your case depends where you are in the AOS process and where your District Office is in case processing. Some AOS applications seem to be processed very quickly, so take this into consideration before spending the $170 or however much it is now. For us it was worth it certainly as we needed to leave the country for a courtcase. The re-entry using the AP was smooth too.

AOS TIMELINE

16th December 2005 - Sent I-130, AOS, EAD & AP USPS overnight to Chicago Lockbox

18th December 2005 - Received at Chicago 9.18pm.

23rd December 2005 - NOAs for I-130, AOS, EAD, AP!! Didn't expect them that quickly

13th January 2006 - RFE for Medical and additional I-864 info

17th January 2006 - INFOPASS Apt about RFE.

23rd January 2006 - Appointment notice for Biometrics on 10th Feb.

10th February 2006 - Biometrics Appointment

21st February 2006 - Medical. Cost $250 including all blood tests, Td Shot, TB test and Titers for MMR and Varicella.

27th February 2006 - Appointment with immigration lawyer re. RFE for I-864.

1st March 2006 - Final results Medical. Papers in hand to send.

10th March 2006 - RFE responses to Lees Summit

13th March 2006 - RFE responses signed for at Lees Summit

24th March 2006 - Emergency AP approved in Omaha

28th March 2006- Collected AP

31st March 2006 - EAD Approval online

7th April 2006 - EAD arrived in mailbox.

21st April 2006- Received Interview Date for 22nd June

9th May 2006- Received SSN

22nd June 2006- AOS INTERVIEW APPROVED

REMOVING CONDITIONS

June 20 2008 - Package mailed to CSC under new rules. Would have been an NSC transfer

June 23 2008 - Package recieved at CSC

June 27 2008 - Recieve NOA1

July 16 2008 - Biometrics

July 17 2008 - Touched

September 9 2008 - Card production ordered

Ive never heard of an AP being denied. Just fill out the form and send it in. Better yet, e-file. Only took my wife three weeks to get approved.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.
