That's why a K-1 only has 76 days to be assigned an SSN with the I-94.

Now there's a FAQ that should be added to every K1 visa applicant!

It's probably only been post on here about a 1000 times.

STEP 5

Will the acceptable immigration document expire within 14 calendar days, or will the applicant’s immigration status expire within 14 calendar days?

If yes is the answer to either of these questions, do not process the SSN card application. SSA cannot print and mail the SSN card to the applicant before his/her document or immigration status expires. If the applicant has applied to DHS for an extension or change of status, advise the applicant to return to SSA when DHS issues the new or extended documents. Follow RM 00204.330 to provide written notice to the applicant explaining that the SS-5 application cannot be processed because he/she will not still be in a valid immigration status by the time the SSN card application is completely processed and the SSN card received.

Now that's the one stinking reference I've never found regarding the 14 day thing.

For the last 4 years I've heard of it... having your ssn applied for prior to the k1 (90 days after entry - that is, 14 days before your passport stamped i-94 expires), but have not seen it until now.

Even though it doesn't affect my wife's situation, it certainly helps to have the real mccoy finally.

she told me basically that it was only for food stamps and stuff like that, if I don't need the gov help I don't need that. I gave her the document of eligibility requirement and even with that she refused. I don't know if it's a problem but we were already married when I went there.

oh I forgot, Montreal wrote with a pen on my I-94 " Sep. X9, 2006 Employment Not Auth"

She said she did not liked that line, that just prooves I don't need SSN

Excuse me... but apparently something is missing here - Unless something has changed with the SSA, the person that interviewed you was correct.

On your I-94, it specifically states that Employment is NOT authorized.

Since she specifically does not have permission to work, (or is attempting to receive public benefits that require an ssn) then she is not eligible to receive an SSN imo.

I'd like to know if anyone here has received an SSN on a K1 without an I-94 with an authorization to work. If so, then ten bucks says that's an exception to the rule and a lot more folks were denied than approved. Furthermore, the DHS is the controlling authority on immigrants/non-immigrant ability to work in the USA, check http://www.uscis.gov/graphics/formsfee/forms/files/i-9.pdf

The requirements there go directly against those claimed by the inclusion of K1 on the chart under item C. The SSA does not give anyone authority to work.

On a lighter note:

I don't know if this applies in your state or not, but you can get a form letter from the SSA stating your ineligibility to receive an SSN and take this to your DMV to apply for a drivers license if that is indeed acceptable to them. In GA it is. (It's called an SSN Denial form letter)

"can be" Isn't what I was referring to. It was the fact that 'can be' and 'has happened' and does happen in some areas is an exception to the rule rather than an ssn welcome mat for everyone without an ead or current work authorization on a temporary visa.

I'm coming in as a late player here (substitution for injury..ah heck I don't know baseballing terms! lol)

So..if you don't need to work, or are not intending to work, you can't get an SSN until after you adjust status? Is that right?

I think I checked no on the DS form with packet 3 about working..but I WILL need an SSN to open bank account n stuff..have I shot myslf in the foot?

Not really... You can take your chances at the local ssa office using the weaponry suggested in this thread after you arrive... but do it quickly after you get here, (within a couple of weeks and don't dally around about it). Oh yeah, even though the claim by some ssa folks is bogus, (as you can see from other's posting about refusals), I'd apply before you get married. Good grief. :hehe:

If you use jfk for your poe you might still be able to get your I-94 stamped with "Work Authorized", in which case that'll be your greatest asset to getting an SSN without any problems. Ahem... just don't make any claims that you need the SSN solely for a bank account or drivers license lest they decline you for that reason alone. You want to have the ability to work.

It'll be virtually impossible for them to say no with a work stamp and your desire/need to work when you apply for it. :wacko:

PS:

It would seem to make a little more sense if the SSA would apply the same protocol to K1's as they do for K3's on this new program here... http://ssa.gov/ssnvisa/who_can.htm But seeing as a K1 is still classified as a non-immigrant visa I wouldn't expect anything anytime soon.

Well Im not going thru JFK..but that might be a good tip for someone who is :)

As for SSN yeah I intend to wait a week after arrival, apply, get one prior to marriage, get married then apply for name change once I get the card thru as advised by the SS god mdyoung in another thread, lol.
