Hi, I need another advice please :help:

I'm wondering whether I should write my stepdaugher's information in I-485. I have not recognized or adopted her yet (and I'm not going to do so in the near future) and my USC husband-to-be (a non-custodial parent) only has her part-time. Does anyone know what to do?

If she is here, and will adjust status, she needs her own separate I-485 and documents and yes, the fee. You do not need to "recognize" (whatever that means) or adopt her. I have not "adopted" (whatever that means, I pay for his shoes, does that count?) my step sons with green cards but would recognize them anywhere.

I think I didn't explain well. Sorry. But she was USC's daughter from his previous marriage. So she doesn't need a separate I-485. My question is whether I should enter her info under my husband's info. Hope it clarifies a little...

Should I regard her as my stepdaugher and write her information in my I-485? Even though my USC husband is a noncustodial parent and only has her part-time (less than 25% of each month)? She was his (USC's) daughter from his previous marriage and she is with her biological mother most of the time. She was born in the US and so she doesn't need a separate I-485.

I had a similar situation (I think!) - my husband has a son from his previous marriage, who lives with us and is obviously my step-son. He was not mentioned on my AOS papers as he is not my son (except through marriage) and he was really nothing to do with my immigration (since he is a USC and therefore not needing any immigration privileges) and not my biological (or officially adopted) child. It actually never occurred to me that he would be mentioned. We mentioned him at the interview (since we showed the IO mother's day cards I got from him) and the IO never questioned why he would not be on my forms, everything went fine. Hope that helps...

Removing conditions:

10/9/10 - Package sent to Vermont

10/13/10 - NOA1 date, received 10/18
