Hello,

I have some questions. I want to help my parents to become GC holders. I am in the process myself becoming a US Citizen and understand that until I am a US citizen, I can not help them. I just like to know more about applying for GC for my parents.

• What Forms would we have to file.

• What documents would my parents need to send in with the filing forms?

On problem we have is that my parents came over as visitors and life through them a curve ball. Unfortunately my mother got sick and is currently not able to travel. Because of that they ended up overstating there visitor visa. They did not intend to come here to stay but sometimes things just take a life on there own.

• Is it still possible for them to apply for a GC?

• Do I need to show the USCIS that I make enough Income to support my parents?

• If yes how much would I have to make? It would be me, my husband (he is a US Citizen would I have to include him) and my parents.

Once you are a citizen you can then file a form I-130 for each parent, you will need to atach your birth cert + english translation if cert is not in English, along with a copy of your naturalization cert, and passport photos from you parents.

The process is just like an IR-1 visa for a spouse, only it does not need form G-325A.

Affidavit of support is not needed when filing the I-130, it will be needed when NVC requests it.

Where are your parents now?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Why did you not apply to extend the visitor visa?
