When I file for my wife in June 09, she will have biometrics in July. But the baby will be born in early July. Her citizenship interview and oath will be in Sep09. However, in the N-400, they ask how many children you have any if they are citizen. 3 questions:

1.Would she have to update the application before the interview or take the biometrics again?

2.What proof/documentation would we have to take for the interview..??passport, social security, birth certificate?

3. Can they refuse her or delay her based on the birth of child that does not appear in application form when it was filed?

Thank you so much!

Sid

Having a baby won't impact how USCIS processes the case. You can't list children on the application that haven't been born yet. Just bring the birth certificate to the interview and they'll update the application there if they feel the need to do so.

If you're really worried about it, you can wait to file the N-400 until after the baby is born. Just because your wife is eligible to file at a particular date doesn't mean she has to do it then.

One purpose of your interview is to update such things as to whether you decided to overthrow the government, though even I don't know how to do that, made additional trips, and certainly having a new baby. That should be great evidence that you are living together as man and wife. Yes, do apply now, and bring a copy as well as the original birth certificate for your new baby. Heck even bring yourself and the baby along with you to your wife's interview, can't go in, but her IO may like to meet the two of you.

Based from what you wrote, since your wife is going for Biometric for N400 that means she's here, don't worry about the baby info, she can mentioned it at the Oatch Ceremony, when they send you the Oath of Ceremony later, there's some update info being asked but you give it to them at the time of the ceremony so it's nothing that will stop you.

IMPORTANT FACTOR

At the time of the Oath of ceremony, the baby will not be around yet, so there's nothing to update, even if the baby is born here in the US before that, there's nothing to worry because the will automatically be an american.
