That sounds like a question that is worth spending a few $$ to speak with an immigration attorney.

I agree. However, is this a denial letter indicating the Consulate will return the case to USCIS or does it ask you for more information? In either case, what is the written reason for denial from the paper? Some reasons aren't worth appealing, because you would lose anyway. Sometimes it's best to start over by conducting the kind of relationship that will end in success.

i went to a lawyer. she said, it no use to refile because the consulate think our marriage is a fraud, they will return the case to USCIS to revoke it. she said i need to appeal or else my wife can't come to U.S for another 10 years. I dont no if it true but it scare the hell out of me. Some ppl said i can just refile. i dont no who right.

I'm so sorry about what happened. I'm also going to have an interview soon under CR1 application. Now i'm nervous about the interview..i wanna know why would the consul think that the marriage was a fraud? what made her think that? Maybe the answers to these questions can help me and other women to avoid this to happen to us. Thank you..

im so sorry to hear this

please state to us why the interviewer believe your marriage is a fraud ..

returning the petition to USCIS to be revoked is not an easy decision and must be built on a very strong evidence ..either they would just put her on AP for long time and this is it

please state the reasons for us so we can give u ideas ..and also for us to learn

Good Luck and have Faith

I dont' understand 1st they are telling you to appeal but you will loose then they are telling you to refile but they wont believe you so you will lose.

How about this refile with appeal that way you address both problems.
