Any April I-130 filers?

I ended up getting a congressional inquiry on our case today. I know we are not at the 5 month stage and if you REALLY REALLY read the uscis page it is 6 months for spouses in the fine print. Reason for the inquiry and the congressman fully agrees is that so many May filers are being approved without expedite. Still at least a dozen March filers to be approved and next to nil Aprils. His first reply to me was well she is from the Philippines and it is a high fraud country. I told him it was discrimination at the USCIS level and they state they try to process petition in order received which they are clearly not. I made him understand that at the NVC level that some countries come under more scrutiny for previous high fraud or majority muslim. We will see maybe I shot myself in the foot and we will be at the bottom of the pile but at this time our petition may be in the trahs as far as I know with NO way to find out.

Just got an email from USCIS, unfortunately it's a RFE :crying:

I went through the copies of all the documents we submitted, I've no idea what else they want from us.

However, I did find a problem:my husband didn't answer question 2 (are you related by adoption)and 3(did you gain permanent residence through adoption) on I-130 form, the answers of which are both "No"

So could that cause the RFE?

Anyway, good luck to all the April filers who are still waiting for NOA2

Hey fellow April Filers, after months of nothing I got email from USCIS, but it is for RFE. But I think I know what for, my wife was late sending me the birth certificates and I sent the I-130 anyway just to get it into the system, so the RFE is not a surprise. But at least I have the birth certificates, and I should have aproval notice very soon. :dance::thumbs:

Well at least it is something!!! No touch even from an inquiry. I would have filed sooner but waited for the marriage cert maybe should have sent petition in then called later and said I had forgotten to forward it need to add to my petition but was not thinking straight at the time wanted everything with the petition before I sent it. Nothing with my inquiry since they have 30 days to respond I'm sure they will wait 29 days until they do.

I am not sure if this was a coincedence but I sent an email regarding my case last week and two days later my case got a touch after 4 months of no activity and today get the RFE. You should try to inquire about the case via email at

csc-ncsc-followup@dhs.gov.

After close to 4 months of waiting, we finally got our NOA2! We are so happy and thankful to God for keeping His promise and for giving us such a wonderful blessing to end the month. We know we still have a lot of things to do but getting the USCIS approval is just a big burden off our shoulder. We are continually praying that the NVC journey is going to be easier and faster.

No approval for us yet. We got NOA1 on April 13th. It will be our fifth month since filing on September 13th. Hopefully this month it comes since they list five months of total processing, on the processing timeframe webpage. But congrats to all of you who have gotten approvals and good luck to the rest of us.

I received my RFE in the mail, all they are asking for is 2 passport photos for me and my wife. I have spoken with my wife and she will get them and send them ASAP and will need to send them express because they are only giving us till September 25 to reply and it usually takes near 3 weeks for mail from her to reach me. But once I submit the photos, I feel I am on my way to a approval. :star:

did you send them the photos the first time?

I'm very confused. Just looked at the NVC site and found the following:

Filing - Two Petitions are Required

You must first file an immigrant Petition for Alien Relative, form I-130 for your spouse with the USCIS Office that serves the area where you live. The USCIS will send you a Notice of Action (Form I-797) receipt notice. This notice tells you that the USCIS has received the petition.

You next file Petition for Alien Fiancé(e), form I-129F for your spouse and children. Send the I-129F petition, supporting documents and a copy of the Form I-797 receipt notice to this Department of Homeland Security USCIS Address on their web site.

I have only filed the I-130 as my husband and I are already married. We got our NOA2, but now I'm worried there will be a hold up because I never filed an I-129. Do I need to do this?

They're talking about the K-3 Visa, in which you must file the I-130 and the I-129. Since you did not file the I-129, you are pursuing the CR/IR visa. You have your NOA2 for your I-130 petition, so wait until it's received at NVC and wait for a NVC number to be assigned. You should be fine.
