Any April I-130 filers?

Hello again, if you guys look at the thread, Lucky 2009 Feb I-130 filers, they all got their NOA2 in one month from the CSC, why cant we be so lucky? And a couple of them it took 2 or 3 months. Ours has to be coming now until July.

Keep your fingers crossed. We are at the CSC just like the feb filers. I hope we get lucky to.

This is my most favorite topic :angry: !!!

I think the short answer is H1B visas. For both situations. I think that the Feb filers went fast because USCIS was trying to clear the desks in preparation for the H1B work visas, and ours are taking so much time now because there is a 15 day priority filing option for the H1B that means there has to be a decision within 15 days (why can't I pay extra $$ to make the process go faster!?!?!).

The good news is that after the first rush there don't seem to be that many pouring in...and the rush has been smaller than in previous years. I'm pretty sure it's almost unheard of to be in June without meeting the 65,000 visa cap.

FYI H1B visas are visa requests filed by US employers for non-US workers. They start filing in the beginning of April (the 5th, I think) and usually run out in the first few days.

If you ask the USCIS, they'll tell you not to expect anything before the 6 months are up. I'm being hopeful and thinking that they'll work through the slug of H1Bs pretty soon and get back to approving family-based visa applications.

Back to your previous post, don't forget that after USCIS, CR1/IR1 visas go to NVC and then to the embassy (and time delay between arrival at the embassy and interview scheduling depends on the embassy). Anywhere along the path you can get thrown into AP which is apparently a black hole of further investigations. So it's a little early to start planning for visa approval for any of us, and I wouldn't hold off on any visit just because of the visa process. If you can go see your spouse, do it! If you wait for the visa you may end up waiting a long time...

Damn, I just depressed myself :(

that's what I told my husband exactly, it's going to take a while. He and his parents are looking forward to spending the Chirstmas with me in the States. However, I told them not to expect that too much. There's no guarantee that I'd get the visa by then,I don’t want to let them down.

Anyway, don’t be too depressed. Look on the bright side, they may finish with the work visas soon. Let’s hope for the best.

09/23/2009 - still haven't got RFE from USCIS in the mail, requested them to send another copy of the letter

10/06/2009 - I130 approved , Never got the RFE though!

01/13/2010 - REF, supplemental information sheet required

01/18/2010 - supplemental info sheet sent

01/25/2010 - sign in failed

I've noticed that the approximate dates for IR-1/CR-1s California Service Center is April 15 yet igor's list doesn't have any April approvals that were not direct consular filings or expedites. How is the approximate date or our timelines keep moving closer? Any thoughts? Is it because the rest of March filers are getting their approvals now?

All quiet on the western front for me. It is those darn work visas slowing us I-130 filers. I guess it is more important for companies to fill their very few open positions with imigrants that for us to be with out loved ones. :angry:

I received NOA 1 on April 7, '09 and no news since. I assume it was forwarded to the CSC since the NOA 1 was addressed from there but have no confirmation of that. Have seen no "touches" or other information about processing from USCIS since registering, I've checked and logged into the site often, perhaps too often making the time go by more slowly. I keep hopiing to give my wife some news about our filing but it just isn't available. It would help to lift her spirits.

When the March filers start moving again we'll know things are looking up...and it looks like *maybe* their petitions are being processed again. The 2 month processing time for the H1Bs is up, assuming most were submitted in the first couple days...

The sooner you are all approved, the sooner they can get to us...since I don't think any of you are planning on dropping your petitions anytime soon :-P.
