Is it ok for my husband (USC) to come stay with me in my country after the 601 is turned in? it has been so long since we have been together hes really thinkin of coming here and findin a job somewhere til all this is finally over...

does it matter if hes not in the US to prove hardship?

I don't know what reasons your fiance put in the petition about a hardship but living there might imply he isn't as tied to the US as your request states and lead to a denial.

the hardship waiver is to prove to the US that he can't live in the US without you. If he can move to your country and work, WHERE IS THE HARDSHIP???? IMO, that would be an instant DENIAL.

Yes, there have been many people who have had a I-601 waiver approved when the spouse was staying with them in their country. In fact, many use it to gather even more and tangible proof of the extreme hardship of living in the 2nd country. See www.immigrate2us.net for more information about waivers.
