Hello everybody!

My first green card has expire date 07/05/08 do I need send package April 6th or April 7th?

Instruction said: duaring 90 days before expiration date-what it means? April 6th?

if your greencard expired on 07/05/2008 they you should have filed last year. If the 2008 was a typo and your greencard expires july 5 2009 then you can file 90 days before that date right up to the date your greencard expires.

sorry-expire date is 07/05/09-type mistake was 2008 year and do I need apply for second green card April 6th or 7 th? because if it is April 6th-then #90 day-is July 4 please explain

my problem is one-do I need count from July 5th or from July 4th? include July 5th?

it is ok if you file the form a few days after the 90 day window opens.. you have right up until the card expires to send it in.. although it is advisable to not wait that long..

what is my windows open?

You have to file your I-751 "within this 90 day filing window". Do not file earlier. Do not file later. Otherwise your application will be rejected if you don't meet these strict filing timelines.

Hi Girl2009,

If I were you I would count "backwards 90 days" from the "card expires" date (07/05/09) that is written on your soon-to-expire 2yr green card.

In your case, your "filing window" would be the following (based on using that online calculator tool I suggested before):

-Day 90: 04/06/09 to Day 1: 07/05/09

For example, my "card expires" date was 11/14/08, and my "filing window" was between:

-Day 90: 08/16/08 to Day 1: 11/14/08.

I filed my I-751 on Day 88: 08/18/08, which they accepted... :thumbs:

But for the last 8 months I'm still waiting on a decision on my case.... :angry:

First of all, this is not a problem.

Second, don't count from july 5th, count from july 4th.

According to that, your 90 days window opens on the 6th of april, which is today.

You can mail it today, or tomorrow with priority or first class.

It will take 2-5 days to get there, so you'll be fine.

Assume 07/05/08 should read 07/05/09, count 07/05/09 as day one going backwards until you hit 90 and use that date for the mail in date. If that day falls on a Sunday, use the date for the following Monday, if Monday is a holiday, use the following Tuesday. That is your date, and use that date as the day you signed your application, this can be done beforehand. We also paid by personal check, from our joint account, both my wife, the applicant and I, the sponsoring USC signed that check and was dated with that date. And we sent it overnight with a return receipt, that canceled check and return receipt is your only evidence that you submitted your application and the USCIS does lose applications. The burden of proof is on our shoulders, and with these three dates all occurring on the same day, they have no grip about that in case you run into a #######. USCIS has those as well.

I think wording like Do not file earlier. Do not file later. are confusing. It should say do not file after the greencard expires - you can file any time before it expires and up to 90 days prior to its expiration. The problem - if you send it too early is - they will send it back. Good Luck
